The jury is in. The verdict: The May 2003 SPECIAL EDUCATION MUCKRAKER "Muck of the Month Award" (MoM Award" has been awarded and is on line at: http://www.specialeducationmuckraker.com/MMA0503.pdf

The May MoM Award has gone to the Fairfield (Ohio) City School District for suspending a disabled 11-year old, who's IEP states that he "has a tendency to wander" and "needs to be escorted at all times" for "leaving his school building." "[T]he boy apparently left through a side door after he had asked for a pass to go to the restroom while he was waiting in the assistant principal’s office," according to a local newspaper account.

An "Honorable Mention" was given to Fairfield Police Chief Dickey, for then permitting the arrest of the boy for "unruliness" because the Department determined that the boy understood what he was doing and was competent.

The Muckrakers' comment, appended to the May MoM Award, notes that the adults all have it backward. The assistant principal should have been suspended for violating the disabled boy's IEP; the police should have arrested the "responsible" adult for endangering the welfare of a minor.

Starting in mid-June, the public at large will be permitted to submit nominations for the SPECIAL EDUCATION MUCKRAKER Muck of the Month Award via the www.specialeducationmuckraker.com web site. Prior recipients of MoM Awards are ineligible to make nominations.

NB - The Muckrakers omitted noting in the May MoM award proclamation that the IDEA's discipline amendments should be amended so as to permit parents to immediately transfer school and district administrators and staff who endanger disabled students by violating their IEP's - to Siberia - prior to any formal due process proceedings to put a dent their tenure, via a newly created "administratively-created-dangerousness" provision. Administrators placed in such alternative settings may be given gainful, supervised work such as disposing of the remainder of the Russian nuclear and bio-weapons arsenal while receiving appropriate group counseling.
