This article upset me so much that I feel the need to vent. Hope noone minds my ramblings and I hope this is not about the mom with the child that was having problems that is on this group who posted her worst fears. If it is, it seems her worse fears have come true. I pray for her and her son and wish to know if there is anything i can do. I think that this is outrageous and is a waste of time and money. I find it hard to believe that a special needs teacher with 26 years experience would be frightened or surprised by the behavior of this young man. Do any of those 26 years include working with children on the spectrum? I would charge the teacher in this case also. As long as ridiculous charges are being given credence by the justice system, why not charge the teacher with child endangerment-for allowing a situation to escalate and causing a child to lose control-and also with kidnapping and illegal detainment-for trapping the child in a room by blocking the door. Also how about a violation of the IDEA law by not following what was specifically stated in the IEP and allowing him to call home. I find this situation totally the teachers fault. She has training and knowledge of the boy and should have been able to handle the situation. This child has an excuse for what he did-the teacher does not. My daughter is agressive, but she cannot be suspended or charged with a crime if the agression is due to her disability.(so I thought) She has broken a teachers nose by headbutting her and never in my wildest dreams would i expect the teacher to file charges. My dd's teacher would not dream of it either and would try to find alternative ways to deal with my child so neither one of them gets hurt. What is to be gained by charging a child with a crime when they aren't capable of understanding consequences? I worked in a psychiatric hospital for years and I was injured often by out of control patients who needed help. I would never have charged any of them with assault-and they were adults. These people come for help and were in an environment where we were to help them and gain their trust. I think it should be the same for the educational system. They are there to help our children-a child should feel safe at school and in a trusting environment. This teacher betrayed that trust as did the justice system and that is inexcusable. I am sorry this is so long, but I am so angered by this i want to spit nails. My thoughts and prayers are with this mom and her son. It is a shame that they have to go through this because of the attitudes of a few. I would like to know the outcome of this case when it is over. I am a special ed teach/ABA provider, and I have had things thrown at me, been kicked, hit, punched, bitten, had pieces of my hair pulled out, etc,etc,etc (now you're all wondering why I still do it) but I would NEVER blame the the child. It is pointless and rediculous. If she pushed him to the point of losing control, ahe ahould have been prepared to deal with the consequences.
