Guest guest Posted August 17, 2002 Report Share Posted August 17, 2002 Kathy and all -- Yes, even tho the new state laws have passed that outlaw time outs, seclusion and restraints, there are plenty of dangers!! The schools are still ALLOWED to restrain any child (sped or not!!) if they feel that the child is presenting a danger to himself or others. And, this person that is performing the restraint may not be certified in proper restraint techniques, which leaves the door open for injury to our children and the person performing the restraint. Can't you just see your child slamming his/her head back and hitting this untrained person in the face and fatally injuring them?? And, then you are stuck with a lawsuit!! The new laws that went into effect August 1st outlawing all these barbaric rituals also state that these professionals DO NOT NEED training until April 1st, 2003 in Positive Behavioral Supports!! And, if a person HAS to use restraint in an emergency, then they have 30 days AFTER the event to get training!! What good does training do after it has happened??? Another thing that is deeply concerning, depending upon the age of your children, is that once a child is 10 yrs old in the state of Texas, the schools can call the local law enforcement officials and have your child arrested or ticketed for behavior, whether it is disability related or not!! I strongly suspect that there will be a sharp increase in the number of referrals of special ed kids to our local police and sheriffs departments!! And, once the referral is made, there is nothing anyone can do about it!! It is then out of the school's hands, and we are at the mercy of the family law judge!! Even if the school changes their mind, it's too late!! We need to group together and be proactive about these issues. We need to educate the local law enforcement agencies about our children and their disabilities -- let them know about ASDs and what that means. And, have stronger wording in our children's Behavior IEPs and BMP/BIPs -- and let the schools know that we will not stand for any abuse!! We need to look out for each others' children!! Because we all know that if it comes down to our kid's word against an adult's who will win -- but if we can be a witness for another child, then the schools will know better than to mess with any kid!! It does seem this is common place. I have shared before how my daughter witnessed a small 4 year old non verbal autistic child in my grandson's class being whacked with a ruler on his hand, bottom, and leg. The Aide in the classroom was writing and acting oblivious to the scene. Later both she and the teacher " documented " that what my daughter said occurred didn't occur. Nothing was done about it. This wasn't even her child, so she had no reason to lie about it. It is so upsetting what does go on. She recommended that when the complaint is on the local ISD, don't contact the local CPS office, but to make your report direct to the state office. Ended up the parent didn't want to pursue it, but the supervisor's advice made sense. Guest guest Posted September 5, 2002 Report Share Posted September 5, 2002 I had to call CPS when the school restrained my child and left bruises all over his body and had blood coming out of his ear. I wish I had known more at the time and taken him to the ER or doctor. I took pictures and turned them over to CPS and filed a complaint. We were in the middle of an embroiled Due Process case at the time and I was more worried that the school would turn around and try to blame me -- another consideration. Even tho CPS did turn the case over to the SD for investigation (which they never did do) I found out several years later that the case is still on file with CPS!! So, it does make a difference. Again, if I had know better then, I would have followed up with CPS and told them that the SD had not done an investigation -- and according to CPS they would have gotten back involved. Many times, even tho nothing comes of the case immediately, you are showing a pattern. However unfortunate, it's still important. Without these previous complaints nothing will ever happen.
