Does your state provide for short term

disability? In New York,

every worker is covered by this and she would qualify for this type of

disability coverage immediately.

It would, however, require a doctor’s

statement that she can’t work. It seems to me that at the least,

she would qualify for FMLA, but that just provides for UNPAID leave.

If she doesn’t plan to ever see that

doctor again, she could speak to an attorney about a law suit, but I’m

not sure what she would gain. It would take an awful long time even if

she could find an attorney willing to take the case on a contingency basis.

My guess is that her only option would be to file a complaint with the federal

government against the doctor. He certainly had no right to disclose her

diagnosis to anyone without her express consent.

I would file a complaint with the AMA against the doctor for disclosing such sensitive information to the employer I would also get an attorney who specializes in disablility cases .

if you have any insight, she is getting very discouraged because its difficult

to be sick and fighting for your life taking interferon and it makes her

sick everyday, and then being off for three weeks and her job now doesn't

want to pay her the disability pay, and the doctor's office is treating

her this way?

Katrina, if your Mom wants to

file a disability claim, you must understand that this is a long process.

If she is in a financial position to do this, that’s great, but

if she’s not, it’s a serious problem.

A disability claim (SSDI) requires

that she has documentation from a doctor that she is disabled and won’t

be able to work for at least a year. Can she get that? Also,

once the claim is filed, it will take months for a decision. I filed

my claim in February and expect my decision hopefully by the end of August.

That’s 6 months with no income. Chances are, she’ll get denied

at that point (which I expect) and then she’ll have to appeal. Evidently,

that can take up to another 18 months.

If she does feel that her disability

will last a very long time, this is something she MUST do as soon as possible

and I agree with Jackie’s advice about seeing a lawyer who specializes

in these claims.

However……..I kind of got the

impression that this is not the case in your Mom’s situation. I

get the impression that she is currently working, perhaps intermittently,

and is concerned about her recent loss of 3 weeks pay and how she is being

treated at work. She is absolutely entitled to FMLA if the company

if she and the company meets certain requirements. I believe she

must have worked there for at least 12 months and there must be 50 or more

employees there. She’s entitled to a total of 12 weeks – unpaid.

She should speak to her human resources dept or the person who handles

the personnel matters for her employer.

I’m not sure what you mean

about her doctor stating that she could be off from work with pay……her

doctor has no control over her employer paying her. If she has accrued

sick time or vacation time, she would be paid, but she’s not entitled

to be paid because she’s ill. If she understood him to say that,

she’s wrong. Maybe that’s why he is now saying that he did not

say it. Did she also confront the doctor about the fax that his

nurse sent? This is something she should address immediately if she

is continuing treatment there or she needs to find another doctor as soon

as possible for continuity in following her case.

I hope that all the responses

you’re receiving will help you in some way. Everyone here has been

there and the problems may have been a little different, but we all understand.

touch me. Your records follow you everywhere, even 4 states away.

It's a slippery slope I would give a lot of thaught too.

well THEY have to be held accountible for their lack of professional behavior. I dont know HOW your info would follow you to another doc 4 states away unless you brought it to their attention... perhaps one should go and see a doc and not give them prior records.. I believe it was the nurse who was at

fault, but the doctor is ultimately responsible for the actions of his/her

staff. In any case, I would do nothing if I needed to continue with that

doctor to the end of tx. If I was moving on to another doctor to finish

the remaining weeks, I’d raise holy hell with the doctor.

I think the actions have to be dictated by

the individual situation. She could point out to the doctor the

indiscretion on the part of the nurse and the fact that a federal privacy law

was breached, but if she needs him/her to get through the next few months,

there’s no point in rocking the boat at this point.

I would hate to see her hung out to dry in

the middle of tx.
