Guest guest Posted September 21, 2005 Report Share Posted September 21, 2005 To All: I have a word of advice about Medicaid or as it is known here in the state of California, MediCal. All those that have been here awhile know that I am dealing with my husband's kids, that have not been supportive at all in my husband's care nor really have any desire to learn about his illness. I have sent them reams of information, which they have not bothered to look at. They believe their father owes them and out of guilt feelings of his past and how he treated them,( I did not know them at this time) he put them in his Living Trust as Durable Power of Attorney in everything. His kids say he has to be put into Medicaid/MediCal. I found out that I was the one that would have to spend down on all my assets that I had saved before I knew Jim, because Jim's assets were all protected. His kids are very wise and know all the angles. They are professional at playing the courts, that is why I do not want to go up against them. They know all the angles, I don't. Just to let you know, in California anyway, you can put the house into a Trust and no one can touch it and put all your assets into a Trust in annuities, so they are protected against Medicaid/ MediCal taking them. My assets were in the open for the taking, but I have since put them into a Trust in annuities. Now, they can put Jim into Medicaid/ MediCal and they won't touch my assets, because now they are protected. I almost had to be forced to divorce Jim to save my assets. Speak to a financial advisor and to Elder Care Attorneys. I had to spend a lot to find out this information and that is another reason why I refuse to spend more.
