I can not tell you how much this touches home with me. We suffered for five

years in an awful awful school district. They caused so much hurt and dammage in

our lives. We recently moved to another state because we had no choice. We had

to move here to care for my Mom. It has been the best thing that ever happened

to us. I'm so upset about all the years we wasted because we couldn't afford to

move. I say do whatever you have to do and move somewhere else. The school

system should not be treating your son like a criminal. They should be treating

him kindly and like a child who needs extra help. I'm so sorry you're having to

go through all of this. There will be better days ahead...can't get much worse

right:) I've been there and thought we had nothing to look forward to.

Everything will get better, it just takes the passage of time.

First thing in the morning hand carry a letter to your son’s

school asking for an emergency ARD.  Get them to sign that they received it.  

At that ARD insist on a new FBA (Functional Behavioral Assessment http://cecp.air.org/fba/default.asp

) be done ASAP with another ARD scheduled immediately after it also ask if the

teacher(s) doing the restraint have been trained in de-escalation techniques

and safe restraint procedures.  One method the schools use out here is from CPI

(http://www.crisisprevention.com/). 

I’d also ask that he be moved to a different teacher’s classroom.   At

the 2nd ARD develop a new BIP (Behavior Intervention Plan) that

utilizes PBS (Positive Behavior Support http://www.txbehaviorsupport.org/

and  http://www.pbis.org/ ).  Since restraint

has been so frequent, I’d ask for weekly meetings with the principal

until the restraints stop.

Second, file a TEA Complaint http://ritter.tea.state.tx.us/special.ed/medcom/compinfo.html

..  They are in violation of a couple of laws http://ritter.tea.state.tx.us/special.ed/forms/restraint.html

..  The statute requires they make a “good faith” attempt to notify

you the day of the restraint and send a written letter within 24 hours.

If you don’t want to file a complaint, at least contact

your local ESC (http://ritter.tea.state.tx.us/ESC/)

and has for the PBS contact and get them involved.

Soo...I get an envelope from Klein in the mail today

postmarked 9\11. In it are " discipline notices " and Restraint

notices dating back from 8\30. He's been restrained oh,, 4-5 times

since 8\30 and this is the first I've heard of it. Also, the

fabled " restraint on the school bus that required a restraint jacket

because he put his head down behind the seat " wasn't in the packet.

Anyone know what the remedies\damages are when a school

district pulls *that* particular stunt other than " bad District? "

And seriously...haven't we got enough to deal with these

days with the TD?
