Does anyone know the TEA guidelines for corporal punishment, specifically if there is an age requirement? Someone told me that they thought children under a specific age could not be spanked at school. My son was spanked yesterday and he is in kindergarten and the principal left marks.

I am so sorry. My understanding is that Texas law allows

spanking or paddling and that TEA leaves the specific policy up to each district.

My understanding is that, unfortunately, that there is not much

you can do about it. It’s just like when the school will not follow

the IEP. They have all the power and we have very little. It’s

NOT right. I hope things change for kids soon. In the meantime, I

am at a specialized private school whose policies align with my beliefs about disciplining

children and teaching children with autism.

You are correct. Most districts choose not to due to liability. what? really? here in Texas? in the USA? spanking a special-need child?

That would be my first priority in changing any laws if I send my son to school before worrying about IEP goals, ABA, vouchers,...etc.

I thought the school districts that offer corporal punishment have to

have written permission from parents to spank their children, but the

fact that marks were left would make me call CPS on the principal right

away- that is child abuse. IF one of us parents spanked their child and

left marks, the school would not hesitate to call CPS on us.

well, he's not technically a "special needs' child since the school dismissed him last year from special education. They didn't want him going to kindergarten with the autism diagnosis, more specifically PDD-NOS. They convinced me that he is not, and I don't know really for sure, but I do know he has a lot of sensory processing issues.

the thing is, I did agree to it. I didn't feel good about it, but the only other option was ISS and that would have to be arranged and would not have taken place til next week. My husband wanted the spanking and so I agreed. But I did not agree for him to paddle him so hard that marks were left. I did talk to CPS today and she told me it was definitely reportable, but this is a small school system in a small community. I am on the Child Welfare board, but the principal's wife is also on the board. It just gets really complicated. I took photos of his bottom last night while he slept and I will look at them again tonight. If it has worsened, like I feel it has, I think that in the least I will meet with the principal and show him the pics. He used to be in middle school. I'm hoping that he just

doesn't realize how hard he is hitting the little kids and he will be appalled and will not hit so hard. If he does not have a problem with it (as my husband does not), then I will rethink the whole thing and perhaps get CPS involved. CPS has to notify TEA, as well. And under no circumstances will I ever allow this to happen again. If I had it all to do over again, I would never have consented. Never do anything against your better judgment, right?

Special-need or not, I am in shock to learn that any one (schools or not) is allowed to "spank" and lay hand on our children.....how can any one stand for that.

I did not go to school here in the USA, and I homeschool one son and the other one goes to a private school, so this is news to me.

Wow!

That is so not right, I would get an advocate or a lawyer to help to remove that

consent form for spanking, first of all, even if your husband doesn't like that,

your child is in risk of bad injuries, that is so wrong, think of the mental

damage to his self stem.

Please get help from someone, as soon is possible.

That principal must be out of his mind, you can still fight back this

situation, even if you signed that consent.. get and ARD done as soon is

possible.

OMG I can't even imagine that someone has a consent form for spanking.

But it is Texas, and they have screw up laws that they need to reform.

I have a lawyer to help us with our 3 sons because abuse of student rights and

lack of info on how much our kids with special needs need it.

The school has always being very nice to us, but they weren't informing us about

the many benefits our boy's could get trough the school district to help them

with their disability.

We did not go to due process but did mediation.

Which it help us a lot to learn our rights.

Please DO remove that consent form for spanking as soon as you can!

If your husband has a problem with you about NO SPANKING specially other than

himself as it is is not good, then your husband may have a problem ( maybe

tradition, country or so and so.)

Then maybe you need to talk to your husband about that before allowing it

I I can't believe that freak actually is a principal.

What county and place are you? if you dont mind?

I only agreed to that spanking, so there is luckily nothing on file that he can be spanked again. I live in rural southwest Texas, Eldorado, to be exact. I found out from my co-workers that San Angelo school district has a no spank policy. Only these rural areas around San Angelo still have spanking policies. Even in the high school. wow. I did not send the form backat the beginning of school, but the principal knew he had to get consent that day or he couldn't do it. I just handsigned that I agreed for him to have a spanking on that specific day, so it cannot be used again. And I won't be consenting to anymore spankings.

Corporal punishment is allowed in Texas schools. Our son’s school uses what is called “passive consent”. At the beginning of each school year they send home a form where you can elect to allow corporal punishment for your child or not. If the form is not returned, they consider that consent.

I live in Del Rio ...far far west..

but i am in Region 15. San Angelo service ctr takes care of us. In

San Angelo i would suggest you call Jam Page if your in our region.

He does trainings and was a special ed teacher ... i wouldnt

recommend him if i didnt think he was 'excellent'...

I agree special needs or not hitting a child only teaches them that hitting

others and hating others is acceptable.

If anyone I knew hit my son for what ever reason I would seek to punish -

friend, doctor and especially a teacher...

(New to the BB with a 6.5 year old wonderful Aspergers son)

It’s been a long time since I researched anything on it.

I seem to remember something about it being a school district decision. Everything

I found today was on the Office of the Attorney General’s website and it

appears it is the TX Penal Code that gives the schools authority for corporal

punishment.
