She is trained in SI, she was hired after the tribunal, which she reminded me was 2 years ago and shouldn't be getting OT for life. I pointed out to her his main sensory problem is with pooh, and he does his poohs at home not at school, but it could be Tesco for the difference, it's a sensory problem and not a home problem, but because I am known to "lose it" in the company of liars which they all are, she gave me the poor ranting loony look. I will now try and wade through all the paper work and find the AR report, but I do know she did not produce that report of hers while I was in the room, I signed the report at the end of the review and left, she was still there so may have produced it when I had gone, but I'm sure the LEA would have amended the statement if it had been there. She presumably wrote this report out after the AR, either way she couldn't give a care what I do next. I will contact a solicitor first thing Monday, it will mean some money up front to kick start the process which means Cambridge conference is out. I couldn't use solicitors for recently because we would have had to pay and from 13 years of autism we are now completely out of money other than what must be found for biomedical intervention. " Should be easy to prove: what was in the school's report of the Annual Review meeting that was sent to the LA - you should have had a copy? Did she write a report? Do you think she is a competent OT? - a specialist in the area needs? I would suggest writing to the LA and say you want somebody else - suggest a name of someone you want. You may need to travel with to take him to the sessions. See if they will agree to funs. Remind them they are legally obliged to provide what'ts in the Statement and thet they aren't. Can you make a case that the OT he's been having is also inadequate because the practitioner doesn't have the right skills? This strengthens the case for a different person. Margaret PS I am happy with Jane Horwood in borough. We travel by train and taxi each week when we have a block of sessions. The return travel takes about 3 hours. The LA are also paying for the travel costs. Otherwise, it might be easier for you to go to London, although there is a good direct train link between Norwich and borough. They HAVE to provide what's in the Statement and yes, you can get legal aid in 's name, I think , to enforce the Statement. Guest guest Posted October 17, 2008 Report Share Posted October 17, 2008 Vicky, I really think you shouldn't have to pay anything - you need a solicitor specialising in education law who does Legal Aid.(I know of a couple.) The application to the High Court would be in 's name so unless he has assets he should get Legal Aid (unless the law's changed yet again!) At this stage, just write to the LA and mention you will be taking legal action if you don't hear from them within 7 days. They may just decide to agree to fund some sessions with someone else, especially if they have some idea of the cost up front.
