Guest guest
This was quite a well discussed topic on my blog in August if anyone cares to read about it and the comments that follow http://tinyurl.com/8rglmz Hilda This is 'crazy'...what can a child that has Autism possibly do to deserve a spanking from...no less...a teacher or admn....this is one of those 'wth' moments for me. > >> > Does anyone know the TEA guidelines for corporal punishment, > specifically if there is an age requirement? Guest guest
How is your son doing? Hope he did not get traumatize. Why did he get a spanking? Is he that bad? I must agree, please remove that y'all consent to the spanking. No child should be punished with a spanking. I hope someone tried to explain on what he did wrong and realize this type of punishment will not happen again as the issue that he committed doing wrong in the school's eyes is able to be taught correctly/redirected on whatever he did. The spanking goes right back to all involve as they have not found a solution to work these challenging issues. Behavioral modification to address the problem avoid creating violence, spanking is not the solution. This is like masking the problem and not correcting it. Any sensory issues to display on what is going on or did he get blame for something he did not do? In other words how much training has this school received? Time for the principal to get his spanking as he needs to empower himself on autism, anyone working with your child must learn about autism, because this could become some type of an abusive fix. No child deserves this. To a spank a child as hard leaving a mark, is uncalled for. What is your child learning from getting a spanking? How to hit back within time, how to hate, how not to trust whenever he does something wrong? When not taught properly. Hopefully you receive answers. Hmm, guess this school did not attend the Texas State Autism conference. Guest guest
Chapter 37 governs discipline. http://tlo2.tlc.state.tx.us/statutes/ed.toc.htm Corporal punishment is allowed in Texas schools. Our son’s school uses what is called “passive consent”. At the beginning of each school year they send home a form where you can elect to allow corporal punishment for your child or not. If the form is not returned, they consider that consent. My understanding is that Texas law allows spanking or paddling and that TEA leaves the specific policy up to each district. Follow this link down to find Texas info. http://www.stophitting.com/index.php?page=legalinfolaws I do not know much else about it but here are some links that might be interesting or lead you in the right direction. http://www.cnn.com/2008/US/08/20/corporal.punishment/ http://www.asbj.com/MainMenuCategory/Archive/2009/January/Legal-Problems-with-Corporal-Punishment.aspx http://www.stophitting.com/index.php My understanding is that, unfortunately, that there is not much you can do about it. It’s just like when the school will not follow the IEP. They have all the power and we have very little. It’s NOT right. I hope things change for kids soon. In the meantime, I am at a specialized private school whose policies align with my beliefs about disciplining children and teaching children with autism. Guest guest
Honestly, I'm not sure of everyone's remarks, but I'm going to cut to the chase. Find a Family lawyer, and pay $100 for him to right a letter stating that your son is not to be corporally punished. State in the letter that it is very clear that Autism Spectrum Children are NOT to be physically punished as they fail to make the connection and the child itself considers this abuse and not behavioral adjustment. If you cannot afford the $100, write a letter to each member of the school board stating what I wrote above, and tell them " This letter is from an Autism parent, the next letter is from a lawyer " . Take control of your situation. A kindergartener shouldn't be spanked, especially by well educated professionals who should know that paddling a 5 year old is a black mark on them, not to mention bruises on their child. One other thing honey, if you want someone to write the letter for you, email me. I'll be glad to do it very professionally, non-threatening, and very informatively. > > Does anyone know the TEA guidelines for corporal punishment, specifically if there is an age requirement?
