I was wondering recently if something typed up, but notarized would be considered legally binding? We have arrangements with my brother and his wife, that if we died, he would take all our children, and we'd leave our house to them, so they could sell it or live in it. As far as and the future...I can't think much beyond that at 11 yrs old. I don't know if he'll ever be capable of living on his own... Have you already begun doing things to ensure that your child is taken care of in the future? (money,guardians..) If your child is older, have you obtained legal guardianship before their 18th birthday? If you have done anything concerning future planning, please share it with us. Guest guest Posted April 13, 2004 Report Share Posted April 13, 2004 I also know, at least here in Calfiornia, at business supply stores, you can purchase " will " kits, I think they're under $30... and basically it has all the legal mumbo jumbo, and you just fill in the blanks, and then go have it notarized. Maybe I'll go that route. Ya know, my aunt just died last month... she was in her late 70's and went in for knee replacment surgery, and died from complications (stroke). We found out her will was not in order... so I was talking to my husband saying things like, " how can you be in your late 70's, going in for surgery and NOT have that stuff together??? " and light a light bulb.. it hit me... " DUH, how can you have 6 children, and not have YOUR stuff together!?! " So it's interesting that this topic came up. Guest guest Posted April 13, 2004 Report Share Posted April 13, 2004 Angel, What I have heard recently -- since my mom passed away is that if it is not a legal binding document it may have to go through court if someone challenges it. My dad had his will updated after my mom died to lay out everything where we just have to show the papers and then everything is taken care of from there. I believe he told me it only costs $100--in Minnesota to have a will written. and I have not done this because we cannot agree on who we want to raise our kids and we don't want to hurt anyone's feelings if we don't choose them. Silly, but it is hard situation and a lot of factors play in to it. Thanks for bringing this up Kristy, I think and I need to sit down and really get this figured out.
