Guest guest
While possible and legal – I think there are a couple of questions for which you need to find answers:Does your place of employment have any conflict of interest policies? Will you be soliciting or seeing patients that you see at work? Does your state, city, etc. require business licenses even if you have no physical office. I mean if I get a tax id number and follow all the protocol that I need to, can I just make house calls and bill insurance companies for my time? I want to keep my 8-4 job at WIC, but would love to do evenings and weekends pp for the non wic moms.I am one of only 2 LC's in my county and the other one is not working as an LC-so there is a huge need in this area! Does anyone have any experience with this? Liz Brown, IBCLC
Guest guest
Absolutely Joan-you are so right! I have considered both points and of course I would be researching both, just wondered if it was legal to do without an "office" Liz Subject: adviceTo: ibclc-pp Date: Friday, January 20, 2012, 3:11 PM Hi girls, my question is ...I am a new IBCLC, I currently work for WIC and have for the past 8 years. Can I,is it legal for me to be a pp LC and not have an actual office? Guest guest
Might be conflict of interest, you'll have to ask WIC. But yes, you don't need an office, why would you? I have worked from my home for over 17 years, just go to the moms house to help her and bub. You do have to have a license because you will have to collect sales tax. Any consulting work in Ohio has to have taxes paid just like a retail sale. Guest guest
You could always become an LLL leader and do it as volunteer work then I'm pretty sure they couldn't say anything about conflicts because you wouldn't be making money off of women that you could be seeing in the WIC office that they would be paying you for. They might see it as double dipping. Cheryl n From: Cheryl n To: " " < > Sent: Friday, January 20, 2012 10:42 AM Subject: Re: advice Might be conflict of interest, you'll have to ask WIC. Guest guest
A lot of professions work without an office. I'm not sure why you would think it's illegal. You will need a business licence, but you will have to check local laws about sales tax and whether it's applicable to services only and consider that if you plan to sell 'things' like books, nipple shields, pumps etc You could always become an LLL leader and do it as volunteer work then I'm pretty sure they couldn't say anything about conflicts because you wouldn't be making money off of women that you could be seeing in the WIC office that they would be paying you for. Guest guest
How would you bill for insurance? Have you found an insurance co that will directly reimburse you? I have not found anyone that will allow for my to bill directly.Consult a lawyer. Are you contract or employed by wic? Check your employee contract/agreement.Create a plan demonstrating you will not treat clients that YOU see in WIC. I think it would be hard to say No to ALL wic clients as that seems to discriminate. I would Let your employer know your plans so your not "going behind their backs".I have a contract that states they support my similar efforts in other communities on my off time as long as it does not interfere with my contractual work.Sent from my iPhone Hi girls, my question is ...I am a new IBCLC, I currently work for WIC and have for the past 8 years. Can I,is it legal for me to be a pp LC and not have an actual office? Guest guest
Hi Liz,I am in NJ. NJ does not require sole proprietors to have a business license, but does require them to register for tax purposes and, of course, to report income and pay taxes on it. It is easy to get a federal EIN on line at http://www.irs.gov/businesses/small/article/0,,id=102767,00.html . 's book, which another post refers to, really helped me get started 10 years ago. Best wishes,Ellen Maughan, IBCLCHighland Park, NJPosted by: " lizz Brown " lizzbrown43920@... lizzbrown43920 Sat Jan 21, 2012 3:28 pm (PST) Thank You Ellen, That sounds wonderful and just what I was thinking of doing!!! What state are you in and do you have a business license and an EIN number? If so were they hard to get? Have you been doing it long? Very interesting, thanks for your help!......Liz
