A deal was made that they wouldn't take any more cases in return for peacefully settling the cases they already had. A bummer for women who didn't know they were ill, and their children. I don't believe you can get any of them who stayed to the bitter end to take a breast implant case! A lot of legal firms were burned on the original implant cases. Quite a number went bankrupt. They signed women up thinking the MDL would make be easy money. Then the MDL collapsed and firms were stuck with cases they couldn't afford to handle. The science was pretty bad too. The mfgrs knew what the problems were, but the attorney's didn't. The science is getting better all the time, but it's not there yet - If it was, Mentor wouldn't have gotten a nod from the panel last week. It takes a lot of money to pursue these cases while tort reform limits the rewards. To tell the truth, the American public has been had. But most people don't have a clue! My mental image is that one day we're going to wake to a country with 90% of the population living at poverty level. All the social support structures are being dismantled one way or another. I pray people wise up before it gets that bad! Early on, my attorney said they would be taking cases for children at a later date. . . When that date arrived and I asked again, I got an emphatic NO! Guest guest Posted April 18, 2005 Report Share Posted April 18, 2005 also What I was told when trying to sue - to get a malpractice suit against a PS, you have to have another PS willing to go on the stand and testify that they think the other PS did wrong - my atty at that time said that that would mean going out of state as they always stick together, and even at that, it would be very hard to find another to go against a PS.
