Guest guest Posted May 15, 1998 Report Share Posted May 15, 1998 Hang in there . I have had 2 denials and a denial from the judge on my first claim. My attorney is now appealing that decision. On my 2nd claim I have denied once, and am waiting for the 2nd decision. My attorney tells me 'we will win', it just takes time. I know it feel very degrading, but it really isn't 'personal'. The ppl making the decisions don't really know you or your level of disability. I am told and have read elsewhere on the net that abou 75 % of the casses that go to the judge hearing level are granted. Don't give up hope. If you don't have an attorney I suggest you get one. It won't cost you anything until there is a judgement in YOUR favor. And an attorney takes lots of stress away from you, as they do the filling out of all the paperwork. And check out the status of your claim anytime you want. I think I got mine so fast because I was, supposedly terminal. That was 28 years ago. I've only had one challenge to my condition and they wouldn't take my doctor's records as evidence. Before SSI's doctor could arrange for an appointment, I ended up in the hospital (frequently). Then SSI took my doctor's records - and I never had any more problems. Stick to it. Get evidence. They try every dirty trick in the book(and then some)so discourage you from going ahead and keep filing protests. This is not a battle for the weak,if you are depressed kiddo,that's where they want you,'cuz you won't fight for your rights as hard. 21 months it took me but I have it, stick with it...need help or encouragement,drop me an E anytime. I've been " down " - not depressed, but very much in pain, with enery level below zero - so I am just now getting around to reading/responding to my many emails. Please don't be discouraged at receiving your SSDisability rejection. I think it's their way of wearing down some so that they give up. Don't give up. After you receive your second rejection (which you probably will), contact a good attorney who deals with this type of case, and let him go for it for you. I have heard that some claims are granted after the appeal, but most of us had to obtain an atty. I was fortunate in that my MD kept very good, detailed records of my every visit - how I looked, acted, felt - said I felt, etc., etc. These things helped my atty. very much. Yes, you end up paying him a % of whatever retro you get, but without him/her, you probably won't get it at all. I did a lot of research via the computer, and whatever info/help I found I passed onto my MD. He is very open to other opinions/options. I was just a year from the time I first applied until my SSDisability was approved - altho I didn't know it til a month later, and it was still another two months before I received my first check.
