I will. First I will tell him I have posted a report on *one* list that includes

people whose names I had passed on to him. And that others will follow. But yes,

PP, TCR, NCTA, the ProZ Blueboard etc. will all hear unless something happens,

in which case of course all previously notified will hear of the mending of the

ways if so.

Dear Dee,

I agree with , you should inform all the payment practices lists (first

of all the P_P one), but I also think that your " gradual punishment scale " ,

is an excellent idea that we all should adopt. That means to alert first a

" small " , but international, circle of specialists likely to be offered jobs

by " the said client " , then to inform the said client of what you are doing,

and then again threatening him/her with the next step, i.e. a complete

worldwide extension. Such a strategy may frighten him/her, while not being

too time-consuming for the translator, and sparing the said client the shame

of a universal disclosure/publication of his/her failure to pay. This said,

we are all aware that the cyber world is only a small village... :-))

And, what do you suggest for the translators that commit theirselves to make

a translation and not just they do not make them, but even they do not

answer to their's client calls?

Ana - I've never done that so I don't know. In any event, what's under

discussion is agencies that cheat the provider. If I think about it, if the

translator does not deliver, the agency will simply go to another one. After

all, they have not paid in advance, whereas in my case the translator has

already supplied the goods, ***and can neither get them back nor sell the time

spent, or the resulting product, for that matter, to anyone else***.

I am posting this warning with 's kind permission as this

agency works in all specialties and language combinations, and I myself

have in the past worked for them in medical matters [even the job

discussed below relates to a food chain license], so that it would not

be inconceivable that one of you may be contacted at some time in the

future.

I have worked with the owner, Fabrice di Giovanni, for almost 10 years

now. UTTA [united Teachers and Translators of America] has always been

run on a shoestring, and payments were never " on the dot " , but also not

scandalously late. To date, I had always considered Fabrice to be a

honest individual running into financial difficulties from time to time,

but with whom I had a friendly, mutually cooperative relationship. This

in spite of the late payments and two episodes last year when a) he did

not make an immediate payment on delivery as contractually agreed, and

B) ultimately sent me a check for over USD 1000, which promptly bounced.

To be fair, he then paid the entire amount including all bank charges,

albeit in installments.

Now, on Thursday January 5, he approached me to help him with an

80-page translation his client wanted in two days!! Naturally I said it

was impossible, which he also knew, and that more time was needed, and

that with a decent deadline I would charge USD 0.xx per target word [oh,

yes, image files at that ...]. Then he came back towards midnight my

time [remember the time difference France - US East Coast, but he know

it as well as I do! ] on Friday January 6, asking me to translate 30 out

of the 80 pages for Monday, at the same rate. I said no, that the rate

quoted had been for 80 pages and an appropriate deadline, and that I

could not do it even if I wanted to because I had other commitments for

Saturday so that left only Sunday. He then, on Saturday, told me he had

negotiated a deadline of Wednesday with the client, and that the client

would pay immediately and that as a result he, Fabrice, would pay me 50%

of my invoice immediately, 25% at 15 days, and 25% at 30 days. The

entire job was estimated to be approximately USD 1100 at this point.

Then on Sunday he called me again to tell me the deadline had again

been brought back to Monday, to which I said " fine, but in that caseI

can't at all, sorry " , and then told me that he had given the last 8

pages of " my " contract to another translator, but that the Monday

deadline was essential, and that he would raise my rate to USD 0.xx plus

20% so I would not lose on the deal. We reconfirmed payment terms, same

as before - 50% immediately, 25% at 15 days, 25% at 30 days.

Although this did not please me much [stress never does], bear in mind

that I had been working with this client for a long time, and naturally

I wanted to help him out in what was a difficult situation for him too.

So I finally agreed.

Well, I did my job - rather nicely, I felt - delivered on time,

offered to help review [at no cost] the 8 pages done by whomever [he

reviewed them himself and I never saw his final review], and ultimately

put the thing out of my mind, fully expecting to be paid the next day

[he usually pays directly into my bank account].

The following day I had another call asking me to translate an

additional letter which even according to Fabrice was " practically

illegible " . He said he would try to get a better version, and not to

start yet. I said I would not start until I had my first payment anyway.

Next I heard, he had found someone else to do the illegible letter. I

was quite happy.

However, no payment. And since then, I have phoned all his numbers [as

shown above, please don't hesitate to flood his mailboxes with enquiries

if you should so wish :)) ] at least once a day, sent emails, explained

that I would report the situation to every professional and payment

practices list I knew unless he made alternative arrangements, that he

was incurring late charges, that Small Claims Court procedures are easy

to arrange remotely, and that I would not hesitate ... NOTHING.

The amount involved is just over USD 900.

So, I am beginning to believe that this was basically tantamount to

fraud and that in fact he has no intention to pay me, since otherwise,

and given our past relationship and the trials and tribulations we have

weathered together, he would at least respond in an explanatory manner

and make some other type of arrangement. After all, I do understand what

it is like to be a small operator in a difficult market. But the silence

is very telling in my opinion.

So, due to this sudden deterioration in the man's payment mores, I

felt it would be better to warn you all to take assignments from him, if

contacted, only at your own peril. It seems probable that you won't be

paid.

Of course, I will update you if and when, and as soon as, any further

developments take place.
