It is supported by Texas Association of School Boards and Texas Association of School Administrators. It would allow public entities to charge requestors for labor, overhead, and other expenses incurred in responding to open records requests if the requestor has already made one request that month and received at least 50 pages of information. The bill is designed to discourage the public from making multiple open records requests in a month. Supposedly, this legislation stems from the extent to which some concerned parents have been watching the Eanes ISD through open records requests. Supporters contends the bill isnecessary to relieve the burden placed on school districts by extensive requests. Eanes ISD allegedly had to hire an additional employee to handle the requests and spent more than $65,000 in staff time and lawyers' fees related to the requests. Personally, the bill appears to restrain the average person's ability to investigate and learn what is really being done with our tax dollars. Generally, they don't want us to know because information obtained via these requests is usually embarrassing to them. Contact your legislators to oppose this legislation. I provided them an Affidavit that I was unable to pay and they said if I didn't qualify for " free lunch " then I couldn't have the records without paying! Someone else told me that I was entitled to view them (which I did in a hurried amount of time) but desperately need copies? Any suggestions? very tired !!!! They can charge like ..10 a page, but that is it. MOST do not charge. You can call the Attorney General for Texas for free adn they will tell you to make a written request and hand deliver it. However, take an advocate with you. IF I'm available I'll go! They can not deny you access to those records; you have a right to look at all of them and to request those that the principal, superintendent, teacher and anyone has. TEA was just fined 440,000 for violating NCLB; too bad they don't know about IDEA violations in the heaps!
