Fist a little background info: My son is 14 and has Asperger's Syndrome. The School District considers this as his " Medical Diagnosis " as well as Depression with features of anxiety. The school district considers this his " educational diagnosis " . He is pretty much a straight " A " student but has some behavioral issues. I have been requesting a Functional Behavioral Assessment as recommended by the LSSP who did his last FIE in April 2006 since this FIE was completed. I was presented with an FBA dated December 2007 in April 2008 AFTER we had a 504 meeting in January 2008. The person who did the FBA was not present at any meetings, nor have I been provided with any type of consent form for the assessment to be performed. He has no BIP and his IEP goals are laughable to say the least (to wit: When Connor is given a direction or lesson, he will keep is eyes and mind on the teacher, his hands on his desk, be ready to answer questions about what the teacher is saying, follow directions quickly and quietly and work until the job is done or the period is over. Master criteria 4 out of 5 trials) This is an ACTUAL IEP goal for my son! I didn't even know he had IEP goals until I received this in the mail in January! I have never recieved it with any of his report cards. My dilemma is: Is the school district correct in their stance that since I requested the FBA be done over the last two years that is " implied consent " ? Second, I was called today by two district employees and was told that there is to be a 504 meeting tomorrow at 8 A.M. I checked with my child and asked if he received any kind of paper or envelope from a teacher or administrator and he said no, so, am I entitled to Prior Written Notice? I have a feeling that the school is trying to pull something by not properly notifying me of the meeting. I understand that they can have a 504 without me, but I did tell them and it is in writing that I would like to attend every ARD and /or 504 meeting held to make educational or behavioral decisions about my child. The school district put in those minutes that they would abide by all state and federal standards and regulations regarding this matter. I believe that if the District 504 person had not called me to today and verified that we were going to have a 504 meeting tomorrow, that the vice principal would not have called meand " invited " me to the meeting. The 504 coordinator seemed genuinely shocked that I was unaware the meeting had been scheduled. If anyone out the can provide me with chapter and verse of the code I need to go into the meeting with to substantiate my claims, I would greatly appreciate it, and pass the info on to other parents who may also be in the same situation. I try to be a good advocate and help others as much as I can. This one is just overwhelming! God bless you all, and thanks in advance! Carol J.
