This legislation will significantly affect the civil rights of people with disabilities, as it will alter the current consent decree process. Consent decrees are agreements entered into by defendants and plaintiffs with a federal judge overseeing the terms, many times to avoid a long, drawn-out, expensive court case. They are often used to settle disability lawsuits against state and local governments. The Federal Consent Decree Fairness Act essentially will force defendants to reprove every four years, or whenever a new civic or government official is elected, that their rights are still being violated.
