Guest guest
Does your son have a BIP (behavior intervention plan)? If so, was it followed? Try going to the Texas Project First website www.texasprojectfirst.org and click on the appropriate age range tab at the top. Follow the links for Behavior and Discipline. Maybe that will shed some light. Regards, > > Hi all, > > My 9yr old son has been suspended from school for one day. He has an > IEP. Guest guest
So where in the IEP does it mention he will not have supervision on the playground? What is wrong with these teachers? This is not a free-for-all with autistic children. Why is there ever a case where an ASD child is bothered by another child? Most autistic kids don't touch another child, unless they are extremely provoked. > > > > Hi all, > > > > My 9yr old son has been suspended from school for one day. He has > an > > IEP. Guest guest
Go to the legal framework at http://fw.esc18.net/frameworkdisplayportlet . You will need to enter a district number but it doesn't identify you in anyway. A little over half way down the page there will be a section on discipline. I think the phrase you're looking for is " Manifestation Determination " . That is a meeting to determine if your child's behavior is caused by their disability. Does your son have a BIP (Behavior Intervention Plan)? If so, was it being followed and does it include Positive Behavior Supports? If not, ask for a new FBA (Functional Behavioral Assessment). If this is a new term for you, the Center for Effective Collaboration and Practice has a great " mini-web " on FBAs in the left frame at http://cecp.air.org Tonya From: Texas-Autism-Advocacy [mailto:Texas-Autism-Advocacy ] On Behalf Of Sent: Saturday, April 05, 2008 9:48 AM To: Texas-Autism-Advocacy Subject: Son Suspended for one day - What are rights Hi all, My 9yr old son has been suspended from school for one day. He has an IEP. The event was rough play on the playground that got out of control and another student was injured. My understanding is that a hearing is required? Before or after the suspension?? Need clarification on how to handle. We have had short suspensions in the past, but that was before the IEP was in place. Thanks ps I have looked at 's website, but am still a little unclear. Guest guest
Tonya, Thank you for the links. They will help me in my prep for the ARD. The behavior is definately related to his diagnosis, ADHD and Aspergers, and the school admits it. I had already asked for an ARD to discuss newly diagnosed vision issues and primitive reflexes. I have already asked for a FBA and BIP. At least we can get those in place before next year. Thanks again... > > Go to the legal framework at http://fw.esc18.net/frameworkdisplayportlet . > You will need to enter a district number but it doesn't identify you in > anyway. Guest guest
I should have included his diagnosis. He is moderate ADHD, HF Aspergers, mild language processing disorder, newly discovered issues with binocular vision and primitive reflex retention. We did not have a BIP in place, but this behavior is not new to him or the school. Last year, for the second half, he had an adult responsible for keeping an eye on only him, from a distance, on the playground. Due to his Asperger's, he just doesn't know when others have had enough of a particular game or when it is getting too rough. We have been working with him, doing lots of role playing. I think he is improving, this is our first incident this school year, but has a long way to go. As far as the classroom, a sub (and parent of a student in the room) has told me that about five children in the class pester my son continuosly. They report EVERY percieved infraction to the teacher. They take his things off his desk prompting outbursts (which then get him in trouble). When he tries to explain to the teacher, the other children will interrupt and insert their versions, which drive him into a frenzy. This happened the other day. The teacher finally asked all the other students to go into the hall (my son was screaming - he was so upset) and the VP had to come and take him to the offce quiet room to calm down. He went willingly with her (we have really pushed the idea that the principals are his friends and only there to help). Because the other student was injured, pretty good bump on the head, he was suspended for one day. I had suggested a BIP during our last ARD at the beginning of the year, but it was suggested we defer it for now. I have requested an FBA and BIP. They are bringing in their behavioral specialist to observe him in class. I am going to request she observe for more than 30 min from the door ( like they did during the earliest evals). I am also thinking of requesting an observation time in the room - effectively to shadow him thru a day or two- to make my own observation of classroom dynamics. While this incident was an example of rough play gone too far, I believe the other actions of the students have provoked some of the other behaviors I am seeing reported. He is being provoked. He has exhibited great restraint some days as has been reported to me, but other days are not as good. For instance, he was called upon for pushing another student in the bathroom. The other student had yelled directly in his ear (he is noise sensitive) and he pushed him away. The problem stems from the fact that he his much larger than most of the other kids, and when he pushes, he overpowers the other kids. Will let everyone know the outcome of the ARD. Thanks for all your tips and links. I have also made an appt with a ped. neurologist at UT Med Center, a Dr. Frye, to further investigate the vision issues and primitive reflexes. I have heard a rumor he might be working with Thoughtful House, so hopefully he won't be so closed minded to the issues we are facing (like many docs) and want to medicate (I won't do). I just need to know everything that is wrong so I can best determine how to help my son improve and adapt. I will also be asking for referrals to a pulminologist (he has asthma), and endocrinologist (he has hypothyroidism), and more as needed. Thanks again. I love being able to ask all of you that have been there. You are a terrific resource and support. > > > > > > Hi all, > > > > > > My 9yr old son has been suspended from school for one day. Guest guest
Happy to help! Other folks helped us many years ago when our son was suspended in kindergarten. Don't hesitate to write off-list if you need more info. Guest guest
Any chance that your son's school knows what is going on with the other kids pestering him and don't want a FBA pointing it out? Guest guest
Once the school completes their FBA and proposes a BIP you can also request an independent FBA. Then you can bring in someone who knows what they are doing. Good luck! ______________________________ L. Guest guest
Hard to say, they have been pretty open. The request to wait was at the beginning, so while we have had similar issues in earlier grades, this year was new. Who really knows. I know that the classroom dynamic have changed for the worse since a new student enrolled around Christmas. This child has really targeted mine for some reason. Will hopefully find out more at the ARD....but I cannot have my child feeling he is persecuted in class. > > > > > > > > Hi all, > > > > > > > > My 9yr old son has been suspended from school for one day.
