disability question

I applied in February and was denied. I did not appeal but instead

hired a lawyer. IF he wins the case for me do I still recieve the back amount

from the date I originally applied?

P.S. any helpful suggestions with this crazy process would be

appreciated.

Teri,

You OR your attorney should have filed a " Request for

Reconsideration " . If benefits were denied on that, then your

attorney and you should file a " Request for Hearing by an ALJ " .

If you " hired " a lawyer and expected her/him to do everything for

you, most likely nothing has been done. Did you sign a " Contingency

Agreement " ? If not, this is a clue your lawyer has done nothing.

Assuming your case is waiting work on by your lawyer followed by a

hearing, IF your attorney wins your case after the ALJ hearing, yes,

you would be entitled to the back benefits.

However, if you did not file a " Request for Reconsideration " within

the 60 day time frame, the SSA dropped your application and you need

to re-apply, with today's date (assuming you do this today) and

therefore, since this is a NEW application, there are no new back

benefits due right now, UNLESS your new application is filed within

ONE YEAR from the intial denial.

I would certainly call the attorney you " hired " and ask what the

he** is up. Was the attorney from nosscr.org? If yes, then get the

attorney on the ball, or else get a new one. Never expect your

attorney is going to do all the work. We specifically ask our

clients to check in with us each week, this is to keep cases in the

forefront and make new notes regarding the health of the client -

you know, we want to keep communication open in these relationships.

Hello Gretchen,

Thank you for your response, but I hve to be honest with you I am

soooooo extremely mad! The things that I didn't know that my lawyer

should of been doing! I gave him $125 and it has been at least 6

months without even one word from him. I have e-mailed him many

times and his secretary also. She is the only one who gets back to

me. I can't believe how he took advantage of me!

I filed originally for disability back in February of this year and

obviously was turned down. I made the appointment with my lawyer

shortly there after. He is a local attorney. I honestly cannot

recall signing anything. But I do have a tendency to forget things.

Anyway, still soooo mad!!!! I really appreciate all the information

that you gave me. Sorry for ranting. But I do feel a little better.

So where do I go from here????

Hi Teri,

OMG! That attorney never should have taken $125. Attorneys are paid by

SSA for representing people, when their case is won. OK now:

Call up Nosscr.org ALL their attorneys do is handle SSDI and SSI

cases. Here's the toll free phone, ask for an attorney near you in PA.

These attorneys know what they're doing.

(800) 431-2804

Then get your file from the bad attorney, tell him he's fired or

whatever. On your first meeting with the new attorney, take your old

file plus any paperwork you have and start from there.

Make sure you save ALL paperwork from SSA and your attorney - make

copies of everything and keep a file at your house.

Hi Teri,

Now, since you were denied, and nothing else was done on your

application last year, you will need to re-apply since a year has

lapsed. You don't need a lawyer to do this, just go to the site

http://www.ssa.gov/d & s1.htm and file your new application on-line.

(It goes right into the SSA Database - a good thing)

As for the * buffoon * who considers himself your attorney, well,

since he didn't do any work he's fired. If you are turned down on

the new application, and turned down on the Reconsideration, then

get a new lawyer, one from Nosccr.org their toll free phone is at

the bottom of the web page.

And make sure you stay in touch (like weekly) with your attorney, to

update on new info or just keep your name in his/her face. We ask

all our clients to regularly call/check-in with us because sometimes

there is often new medical information, a new prescription,

surgeries, etc.

ALL your doctors should write a letter confirming your symptoms and how these

make your disability " severe " enough that you are unable to work. Don't let the

docs use these words " she's disabled " . It is NOT the doc's job to determine

" disability " , just provide medical

information to support your claim. Also, if you use any assistive

devices, like AFOs, wheelchair, etc., your docs, and even your

orthotist or PTs might want to write reports on your behalf.

I would venture to say they might want to see how Depressed you are, if you are

at all. That would be my guess.

That's what they did for me in 1991. I didn't understand it either, but it

worked. Don't knock it if it works. Good luck,

When I went to the disability " doctor " it was a nurse practionar. I think they

contract with several doctors and NP's that are avaliable. The Psychiatrist is

still a MD. So I am sure it is fine. I got it in less than 6 months, so it does

work most of the time.
