The manufacturer's were probably Mentor or Inamed. . .

The same ones trying to get approval for their " new,

improved model " that's safer.

We've been hearing this for years! . . . The next one

is always the safe one. Hasn't happened yet!

There is some talk of starting another class action

suit. Mentor, in particular, continued making an

implant with a faulty valve, long after they knew it

was faulty. Quite a number of our women had that

implant. Maybe one of them knows an attorney

interested.

Problem is, with " tort reform " , they have capped the

damages while making it increasingly more difficult to

prove injury. On top of that, now class action suits

have to be heard in Federal court . . . which means

judges chosed by the president, based on whatever

his/her bias is at the time of appointment will hear

the case. This is also intended to jam up the Federal

courts so action can be delayed signficantly.

When you have your implants removed, they should be

identifiable. At that time, they will know if the

valve was faulty. If your doctor doesn't know, Dr.

Blais will. . . Of course, that means sending them to

Canada. If there's a chance of a lawsuit, make sure

you don't take possession of the implants. They should

go directly from the explanting doctor, or

pathologist, to Dr. Blais. Dr. Blais can give you

shipping instructions.

HI,

Rogene, are you talking about silicone gel valves or

saline valves. I am not sure if gel implants have

valves.

I did not think there were any law suits for salines.

I think there are some lawyers considering cases

against Mentor for defective valves on their saline

implants. Mentor apparently knew it and continued

manufacturing them anyway.

Hi, Your physician should have written the

manufacturer and possible serial number and lot number

in your medical record. I know that they must write

down the manufacturer and style and how much saline

was put inot them.

Or, once they are removed the implants are labeled.

Hi Rogene...Yes, it's been a long wait. At first I didn't pay much attention to the implant news thinking that I was lucky not to be having any problems. But, in 1994 when I heard about some of the silicone implant symptoms on TV...I thought..."hey, I've got some of those symptoms too"...and so began a round of tests...my implant seepage (MRI test) went on to become a full blown rupture in both implants (however, I didn't have an explant until 2000).

So, I entered into the lawsuit and have been waiting since 1994. I'm fairly okay, whatever that might mean...but, am interested in learning on this site that implants can cause destructive arthritis...osteoarthritis is not covered in the disease part of the claim by Dow Corning.

Often they can be identified when explanted, either by

your doctor, or Dr. Blais.

However, your medical record should have the stickers

that were part of the packaging on your record. If you

were implanted at a hospital, the record should be

there. Doctor's offices are not as diligent in keeping

these records, but they may have them, or a note in

your record about which brand was used.

I'm not surprized that you didn't make the connection

until late. . . the manfacturer's were running a

campaign to make sick women look like money grubbing

sluts! . . .

And . . . many illnesses the women were KNOWN to have

were purposely ignored in settlements like the MDL.

Since it is so hard to prove a direct relation between

implants and our health issues, it was virtually a

slam dunk for the manfacturer's - even if they did

settle for millions, it should have cost them far, far

more!

In the meantime, courts were rewriting the laws to

make it increasingly more difficult to make a case.

Now, it's extremely difficult because all class action

suits must be heard by federal judges, and limits make

it so expensive to take to court, most attorney's

aren't interested. These cases are very expensive to

handle. Many law firms went bankrupt because of

implant cases.

If you intend to file suit, I suggest that you have

your doctor send your implants to Dr. Blais. His

report will be excellent ammunition in court. . . From

there, have the implants sent to your attorney, if

your attorney agrees to take custody of them.

Hi,

I donot know the answer to this. I would think you

need to either send them directly to a lawyer (Just in

case) or DR. Blais. I think he would probably store

them for you possibly at no charge.

Hi Rogene,

Sorry to have taken so long in answering...I was in CA and got way behind on the posts...I'm finally going through them a little at a time.

I had a lot of tests taken in CA...I have symptoms, but nothing showed up on the tests.

I will finally be paid for my Dow claim sometime in July...the checks go out once a month and mine is ready to go on the the pay out.

You probably saw my post about liens put on the Dow Corning claims...some of these liens are not warranted and so I posted the name of an attorney, Galardi, who is very adept at removing them.

Hi Shirley,

Thanks for posting the attorney's name . . . They're

tough to come by! . . . One of our women told me that

Frailich dumped her! . . . I don't remember the

details.

I wonder if DOW would tolerate payments that late???
