I need some advice here?

I intend to homeschool though her preschool years. I am being told that if I refuse the evaluation that they can " file a due process hearing against me" and or " request mediation with me and the Ohio Dept. of Ed.".

Of course AFTER the evaluation I am free to homeschool.. TILL they decide to RE evaluate. I have all this in writing.. I never heard of this stuff before.

I want to drive Sam to the school to get her therapies and I am being told that I can not do that. I might be able to get a Teacher who " consults" with the therapists.. to come to the home, but that is about it. either way They have never done it before. I am supposedly the first person in my area to refuse traditional preschool after accepting EI.

I have nothing against inclusion.. but if your asking ; Why? Simple... I was told to raise her as i did my other kids.. and we homeschool. So why would or should I have to send her to school at age three if I did not do that with the others?

I got a call from the district today telling me TODAY was the only day they could do the evaluation.. as her birthday is Sept 2nd. ..So I allowed them to come to my home to do PART of it but the big eval happens a week from Friday. Just what? 4 days before her 3rd bday.

-My son did not receive preschool classroom services through the school district but did receive therapies. I took him to the therapies although for awhile one of the therapists did see him at a private specialized preschool we enrolled him in from age 2-4. We did have the evaluation. Once we moved to a better school district my son attended one year of preschool. Since then he has been in a combined program - part of the day in the Gen Ed class and part in the special ed class. I have never heard of this either. If you are wanting to use therapy at school, they would have to do evaluations for the therapies..... but something is not right.You need to contact a home school lawyer!!! Are you a member of Homeschool Legal Defense? Any other homeschooling families you can talk to.Why on earth would they file a due process on YOU? What do they intend to do with this information if you are not attending school? Do they get paid somehow? Why are you even talking to school if you are going hs? Are you hoping to get services from them only?There would be a lot of questions I would want answered and sounds to me like they are rushing you to keep you from thinking or getting the correct answers. Nothing moves that fast at school

Before Faith turned 3 she was in EI and was evaluated. I observed the developmentally delayed preschool the district offered and told them it was too restrictive and didn't meet LRE. There were no typical children and most had a speech delay. How would she learn to talk with no models?

We enrolled her in a church preschool and told the district we wanted to access speech therapy. I took her to an elementary school for the therapy 2 times a week. I have since learned that I probably could have gotten the district to pay for the private preschool since they did not offer an inclusive environment.

Go to slaw.com and educate yourself on the law. Go to your state DOE and learn the laws of your state. Don't be afraid of the school district threats. Due process can take several years to go through the system. Ask why they would want to do that or mediation?

Your state may not allow you to access speech therapy if you homeschool, states have different laws about that. Florida offers speech to homeschoolers if the resources are available, but does have to serve children in private schools.

Is there a reason you don't want the evaluation?

When you say you "accepted EI", what exactly do you mean? Do you mean you had therapists who came to your home as part of the EI program?

I'm also in OH, and in our county (Trumbull), there was an EI developmental specialist who came to the house, but only until was 18 mos. Then, they expected me to put him in the EI classroom, 2 days a week for 4 hrs. a day. I declined. So, according to them, we "opted out" of the EI program. I take to the very same building, Children's Rehab Center, that also houses the EI classroom, as well as their preschool classroom. sees the same therapists that work with the children in the EI program. Only his therapies are paid for by his insurance (which is state funded insurance), because his pediatrician wrote prescriptions for therapies for him. So, if the board of education won't work with you because you aren't going to send Sam to their school, I'm wondering if her pediatrician can get therapy for her elsewhere.

has been part of a free program called Help Me Grow. Nothing real big, but a young woman came to our home twice a month and brought developmental toys and books and played with , sometimes gave him free books, inquired how things were going, made suggestions concerning any issues, left materials, recommended and even loaned books to me, let me know of available programs that might benefit . It goes up to age 3, and he just turned 3 on Sun., so he has "transitioned out" of Help Me Grow. But part of her job was to help to get an eval with someone from the board of education set up for if we wanted it. We declined, and that was fine. I just had to sign a paper saying that she had offered and that we were declining. No pressure. No talk of filing anything against us. She

talked like we would probably have been able to get at least speech therapy through our local public school (taking him there for it), but would have to get an eval in order to get him therapy through the school. Since he already is getting his therapies elsewhere, we decided to pass on that one.

So, from one who lives in the same state, what they are telling you just doesn't track! The state doesn't own Sam, just because she has DS, anymore than they own your typical children! You can homeschool her without their permission! Sounds like someone is trying to intimidate you. Bluffing! I'd be leary of letting them get their "paws" on Sam!God's Best!

Have you contacted Home School Legal Defense Association yet?

They can tell you if this is a legitimate claim on the part of the school…sometimes

the school district/EI do not know the law, and HSLDA can call and get them

straightened out for you.

In Indiana, I just told the EI people that we were going to

homeschool Danny because that is what we did with all of our other kids. We did

not have to have him evaluated by the school…in fact, we have had no contact at

all with the schools for any of our kids.
