Medical Board Suspends License of Emilio Luna, M.D., of AZ

On Monday, November 8, 2010, a panel of the Texas Medical Board temporarily suspended the Texas medical license of pediatrician Emilio Luna, M.D., Lic. No. M0156, of Sun City, Arizona, after determining that Dr. Luna's continuation in the practice of medicine presents a continuing threat to the public welfare.

The Order of Temporary Suspension with Notice of Hearing was based on Dr. Luna's restriction of his Arizona medical license and indictment by a grand jury in the United States District Court in Arizona on September 2, 2010, on five counts of knowingly distributing child pornography through interstate commerce. The suspension was effective immediately. The length of a temporary suspension order is indefinite but it remains in effect until the board takes further action.

On September 9, 2010, Dr. Luna was granted pretrial release by the District Court, which stipulated house confinement with electronic monitoring. Dr. Luna was allowed to leave his home for approved reasons, including a church service September 12. Later that evening, local law enforcement found Dr. Luna's vehicle, which contained bolt cutters and the electronic monitoring device, abandoned in a parking lot. Authorities believe Dr. Luna may have fled to Texas, California, Illinois, or his birth city in Mexico.

The evidence of Dr. Luna's criminal conduct, characterized by knowingly distributing child pornography through computer files, as well as his fugitive status, demonstrates that he is not only a continuing threat to the general public health and safety, but also an immediate and continuing threat to the health and safety of children, to whom he has special access as a pediatrician.
