Guest guest Posted November 20, 2005 Report Share Posted November 20, 2005 Hi na, I have had 5 different Elder Care Attorneys look at Jim's Trust and they all say the samething. He has set it up in a way that all the money goes to his children, he did not want it to go towards his health. He stated it when he was of good health and sound mind. (I question that he was of sound mind. LOL) He wanted MediCal to take care of him, so that his money would all go to his 3 children. He even knew how to protect all of his assets against MediCal/Medicaid taking them , so that it would not be counted as assets. He never had to spend down on a dime. It would have been me, but I learned off of him what he did, so that I would not have to spend my assets. It is because of that request that he be taken care of by MediCal that the Trust can not pay for his care. He has tied my hands from being able to do anything for him and put himself into a pickle. I have done all I can do for him. How long has your mom been paying the $5,000.00 a mo? So much for the facility shopping that I did all last summer, because when it comes down to it, he will end up wherever there is a MediCal room available, because I will have the hospital transfer him to a faciltiy with a MediCal room available next time he goes in.
