The ADA Restoration Act of 2007 (H.R. 3195) was introduced by chief cosponsors

Representatives Steny Hoyer (D-MD) and Sensenbrenner (R-WI) in July to

restore protections for Americans with disabilities under the Americans with

Disabilities Act (ADA) of 1990. This bipartisan bill will amend the ADA to

require courts to focus on whether a person has experienced discrimination “on

the basis of disability,” as Congressional had intended when it passed the ADA

in 1990.

The courts have dramatically narrowed the definition of disability in

employment discrimination cases. Employers are winning cases by saying a person

is “too disabled” to do the job but not “disabled enough” to be protected by the

law. Persons with disabilities must meet this nearly impossible standard of

disability often before the issues of discrimination is ever addressed.

Status

As of September 20, we have 198 cosponsors - just 20 shy of the 218 needed to

have a majority of House Members in favor of the bill. Hearings on the bill

will likely be held after the 218 cosponsors are obtained.

Take Action

October is National Disability Employment Awareness Month. Congress

established this commemorative event to increase the public's awareness of the

contributions and skills of American workers with disabilities. Let's honor

this event by helping to get hearings scheduled in October on the ADA

Restoration Act.

We need your help to bring your Representative on board in order to get a

majority of the House of Representatives to cosponsor this bill. Thanks to the

hard work of our grassroots advocates we now have 198 cosponsors. We're in the

final stretch to get 20 more members to meet our goal of 218!

Please write to your local media to bring attention to the ADA Restoration Act

and to garner support for it by other constituents in your area. A sample op-ed

and letter to the editor are provided when you enter your zip code. Feel free

to use them as the basis for your own writing and include any case examples from

your federal district or circuit courts provided here. You may wish to select

the top 3 media sources in your community which you think are most likely to

publish your letter to the editor or op-ed. As a rule of thumb, media outlets

that cover smaller areas are more likely to print submissions from the public.
