From my non-legal experience you probably have A WC claim. So you have my empathy on that one. Sincerly,Elliott Mantell DC

Hi everyone,

Patient owns own pet walking business. Van for business was struck from behind. It appears that her business insurer is telling her that since the person that hit her admitted fault, she didn’t have to report or get claim started with her own insurance carrier and could just bill the 3rd party for all necessary medical. I called him (he was exceptionally rude) and told him that no matter fault her insurance carrier needs to be informed and all bills etc. go through her insurance first, regardless of fault. He didn’t like hearing this.

I’m also wondering whether this would actually be a work comp insurance claim and whether he was telling her to not begin a claim with her insurer to avoid the claim being steered back toward the Work Comp venue (which I believe he represents).

guidance on this??
