I'm not trying to rub salt in the wound, but I received a response today also saying I've been approved. But let me tell you my history. I last worked Aug, 1999. At that time my doctor (internist) put me out of work because he knew I could no longer physically and mentally do my job anymore. I went on company short term disability for 6 mo. Then I had to apply for long term disability that I had paid for for 21 years (that's how long I worked at this one company). It took 3-4 months to get approval for that and when I was I did not receive a full payment from them but only a check for $300.00 a month (good thing I wasn't my sole support!) At that time the LTD company urged me to apply for social security which I did. I was turned down a year later for about the same reasons they gave you today. I applied again and was turned down about seven months later. At the same time my mother died and I really just wasn't in the frame of mind to deal with it anymore. Than I realized that if drug addicts in my state could go in and get SS right away, by golly I wasn't going to quit! I found me a lawyer last June and he got busy. He only gets paid if I do. I had my hearing in June of this year and finally got my answer today of YES. It took me three years to fight it but I got it. And in the judge's letter he said that " the State agency consultants (who made the first two determinations) failed to consider the combined effect of all the claimant's impairments as required by the regulations. The State agency did not adequetly consider the entire record, including the statements of collateral sources. " The judge found my impairments to be " severe under the Social Security Act as follows-psoriasis and psoriatic arthritis together with osteoarthritis with underlying fibromyalgia syndrome, anxiety and depression, restrictive airway disease, allergies, irriable bowel syndrome, gastroesophageal reflux disease and history of esophagitis. DON'T GIVE UP Ali, I had idiots who did not follow regulations and consider proper evidence. So please, get a lawyer if you must. Good Luck, Theresa in Fla. Guest guest Posted August 16, 2002 Report Share Posted August 16, 2002 Ali - Sorry to hear you were denied. If it's any consolation, I have heard that most people are denied on their first try. Don't give up!! My husband is on disability because he is on oxygen all the time. I suppose it would technically be possible for him to do a desk job, but SSI has ruled that he is totally and permanently disabled and he is able to think (well, I guess he is - sometimes I wonder when I'm mad at him if there is a brain in there after all!) I will talk to my rheumy but he has said that he thinks I should get SSDI. I know if I go back to work I would probably do more damage than good to myself but .....I just don't know. I knew they would deny me on age and education. I am fighting off more anxiety and depression, I have held it at bay for a while now and to give in to that will be like going back down hill the little bit I was able to gain going back up. I used to be anxious and depressed all the time course now I find myself having large boughts of apathy and a general feeling of just not caring. Don't get me wrong I am not suicidal or anything (though I was borderline suicidal about 2 years ago, but I have too many people caring and loving me to even consider actually going through with anything so permanent and severe). Anyway still trying not to go out into a full fledge vent until I can think things through better. Thanks for responding. I just don't know if I want to fight when I have no clue if they will ever approve me. I agree with others who say if drug addicts can be approved when it was their own darn fault for their condition then why can't other's that had no say so what so ever in their condition. I plan on calling my rheumy's office on MOnday and talking to the Remicade nurse...she is very sweet and she will tell my rheumy my concerns and what I would like to request. I will keep everyone posted on my progress. I have tried not to think about it much today but to focus on other things that I need to do by the end of the weekend. Sometimes I wonder how much worse things need to get before they start getting better. Especially after my mom died just after I had gotten the second denial. I let it go almost too late-but thank goodness I went for the lawyer--I swear that's your best bet. Get one like I did--they only get paid if you are approved. After all the fight, it felt great yesterday to get that approval letter in the mail yesterday. I know it's just words but DO HANG IN THERE! I'm only 41 and am still considered " young " to be disabiled--but we're not the only young ones out there! I agree with everyone else...get an attorney and appeal this decision, and don't give up! You will eventually get a favorable decision. The Psychologist the state (OK) sent me to advised me to appeal if my claim was denied. Please consider trying other meds (treatment) for depression. This will help you deal with the PA and the hassle of going through the appeal process. It's always good to vent too! You're not alone here! DEPRESSION I had Hep C, Cirhosis on transnplant list and was turned down twice. Third time I put depression lst and I got it. If you are depressed it makes it hard for your mind to work correctly. You do have to have documented depression though drs or therapists. My feeling is anyone with a chronic illness, especially one that hurts is going to be depressed. What I don't understand is the only medical records they used were from a doctor that treated my knee injury & the doctor that diagnosed me with sleep apnea. Why wouldn't they have used the doctors that treat my CMT like my neurologist or my PT? Just another one of their tactics I am sure. So now I am getting a lawyer. I have been awaiting a hearing in front of the judge for several months now. According to my attorney the docket is full up past the new year. It's not very comforting. Hang in there.
