It depends on the policy and company involved. Some companies have a one time

accident forgiveness.

Dr. Medlin and colleagues, understand there is nothing in Oregon statute nor are there any Oregon Insurance regulations that prohibit an insurer’s auto PIP

carrier from raising their premium rates for being in an accident due to no fault of their own. With that said, I’ve never had a patient in 31 years of practice complain that their rates went up from an accident that was documented clearly as not being their

fault. However, it seems like I recall on gal a patient of mine who had been in like four or five rear-end collisions none of which were her fault (supposedly) I treated her for two and I believe I recall her complaining sometime later that her premium rates

went up…

The whole premise of auto PIP is to protect you in case you are injured in an auto accident if it’s your fault or not and if it is not your insurance company

is reimbursed from the at fault carrier……Vern Saboe

Subject: PIP question

Hello,

If a driver is innocently struck from behind in rear end collision is not in the least at fault, will their insurance rates go up if they pursue treatment for injuries sustained

in the accident? Have a patient who is attempting to go through the third party in order to avoid reporting it to their insurance company to avoid a rate hike.

Thanks,

ph Medlin D.C.
