If the collision was not the insured's fault, their rates cannot go up. If an insurer gives a small "claims free discount," they can lawfully take that away regardless of fault, but that's usually no more than 10%.

The at-fault carrier is not going to direct pay your bills, and won't pay a dime toward the injury claim until the claim is fully and finally resolved. I'd encourage the patient to file a PIP claim.

Hello all

Arent they by law required to report the claim to DMV if the is bodily injury or $x vehicle damage (is it $200 or $400?)

Elliot, if damage to vehicle is $1,500 or more the accident should be reported to 'DMV.  I just gained first hand experience with this recently.  This is what one of Portland's finest told  me just a week ago.

Will you are correct DMV in Oregon says:

ONLY drivers involved in an accident resulting in any of the following MUST file an Accident & Insurance Report:

• Damage to your vehicle is over $1500

• Injury (No matter how minor)

• Death

735-32 (1-11)

• Damage to any one person’s property over $1500

• Any vehicle has damage over $1500 and any vehicle

is towed from the scene as a result of damages

So at least Joe's patient fits into Injury category.

I still get this from patient's saying that they were told that the responsible party would pay our bills, and as has pointed out it never happens.
