And if they’re trying to say they will pay 80% of the comp fee schedule, or 80% of the amount you charge the public, then ORS 742.525 and Strawn v Farmers (http://www.publications.ojd.state.or.us/Publications/A131605.htm) say they can’t do that and they may open themselves up to a class action. And thanks so much Hill and Vern for your replies! Apparently, this is a Florida Rated Claim and they shouldn't have paid anything as she was not in Florida and in an uninsured car at the time of the accident. "They will not be able to pay anything on any further claims".
