Guest guest
Hi Alison Sorry to hear about your difficulties. You should be able to find info on costs of any school in the school's prospectus. I found cost of Chrysalis school in a pdf copy of their prospectus on the internet last night. Failing that, phone the schools and ask them - there is no reason for them not to give you the information. Cost of an escort - ring the relevant department in the LEA and ask them. If they wont give you the info, use the Freedom of Information Act (they will give it you then - they cant justify not doing). Taxi costs - when I asked the LEA said they couldnt tell me because it would be prejudicial to the tendering process. You could ask which taxi firm they use, and then, as you suggest, ring that taxi firm. If they wont tell you which taxi firm, then ring the school that you want the taxi to go to and ask them which taxi firm the LEA uses, and then ring the taxi firm. FOI Act does not work in this instance if they are bleating on about tendering processes. Guest guest
Alison Is ABA statemented provision? What does it say in your statement? If it is Statemented you need a solicitor to issue proceedings for Judicial Review of the decision. This can be legal aid funded in name of the child. Threat of JR usually sorts them out and makes them back down. I had to do this when I was running an ABA programme and Camden just pulled the plug on funds. Unlawfully. They only backed down a couple of days before the hearing though, but then signed a consent order, legally binding. Guest guest
Celia, This is interesting. A message on ABA UK yesterday said that in the event of the LEA issuing a new Statement which withdrew ABA the child was not entitled to continuation of the provision that formed part of the old statement - the newly finalised statement is the one that is binding on the LEA. (So no remedy while the Tribunal Appeal is still going on?) I am really worried about this happening to us! Margaret

Guest guest
Hi Margaret I am sure that is not correct. The LEA first has to issue a Draft proposed statement which of course gives parent right of appeal within timeframe. If the Parent appeals to Sendist, the LEA must continue the current Statment pending Appeal. Dave Ruebain of Levines told me at the time this funding problem happened to me (one of many funding crises over the 7 yrs we did ABA) that he had never known a LA test the law out by refusing to continue funding pending the tribunal appeal, and he thought High Court would not uphold that. IE they could not get away with it if they tried which was very unlikely. Don't forget they all bluff until you call it. A Finalised Statement is not legally binding on the LEA if an appeal is in process. Think about it - if the fight were about a school, it would mean they LEA could yank a child out of a school, stop funds to a school, pending the few weeks in the run up to a hearing. A JR would throw that out! Same thing on ABA funding. Celia > > Celia, > This is interesting. Guest guest
Celia What you say makes perfect sense.......sometimes the rumour mill goes into overdrive (to the detriment of parents). It certainly had me worried. Thank you for clearing that up. Zoe > > > > Celia, > > This is interesting.
