They lie because they always lie. Anybody who thinks that LEAs have the childs needs at heart instead of the money and the power and the careers is living on a different planet or not really asked for (cash) resources. Although I nearly crashed a few weeks ago and would have if it wasn't for a friend. So long it's been. It's all about the obsession they have that all children should be in school. And Adam's needs cannot be met in any school that exists but they would prefer to shove him into a school that does not meet his needs as opposed to going down the home-based package again. Well stuff them I have seen them off over that and the principle is now agreed that they will fund provison in a home setting - albeit they now want to curtail it to normal school hours etc and minimise their costs. They have issued a draft statement changing his needs and provison (which on current statement is residential and waking hours 1-1 provision etc) without any professional input into that. As if! They want just minimum and let the rest fall on me - HA! I am going for 2.5 full time staff minimum for waking hours seven days per week 52 weeks per year.In addition to professional secondary subject teachers coming in to do all the academic stuff. (which includes quadratic equations and A level math and physics). And home-based ABA staff to do toilet training and behavioural modification and independence training etc etc. I so hate them I have written letters to their Auditors reporting them for abuse of public funds and the Children's Commissoner complaining about their behavour to Adam and to the new Secretary of State for Children Schools and Families asking him to visit us to see for himself the plight they have left us in. I will use the press if necessary now - I have HAD ENOUGH!!! BUT today I am happy - a glass of wine calls! Guest guest Posted July 18, 2007 Report Share Posted July 18, 2007 Well it's interesting becasue it's the first time I have used this tacic. The formal complaints procedure. First you make a formal complaint which they treat as stage one. You have the right to escalate to stage two. Of course most of them including Camden don't tell you your rights or respond in the way that legislation says they have to. But once you make a formal stage 2 complaint you get an Independent Person and and Investigating officer (also has to be outside the service you are complaining about - but not necessarily the LA - in my case it was somebody outside the LA). The thing is if you have grounds to show that they are unreasonable in their behaviour to you - and even better flouting the legislation - you can complain about it. If the investigation upholds your complaints then you can take the case to the Ombudsman and get compensation. Even better - they so hate this process that you are likely to get what you want. It's a good way to get things moving it seems when the bloody LEA or SS are being bastards and refusing to meet you child's needs. I had good advice from an Independent Sowal Worker about the process. It helped me be confident. I see this as in addition to Tribunal and or High Court. Lets face it financial compensation at the end of the day would be good. I filled the form in online using some legal blurb provided here by our own Margaret (thanks again!) and it was resolved at stage 1 as I made it clear I would proceed to stage 2 and eventually Ombudsman if necessary. The legalese helped along with my reputation for being a moaner in the Borough (and he is only 6!).
