They have an obligation to offer him suitable education Vicky. You would

find the wording in Code of Practice on SEN. I used to know it off by

heart. The paed's letter should establish that the present school is not

suitable. If they have no places in other lea schools I would have

thought they would have to find him an independent one or another lea. I

would say ask for a school place first using the paed's letter to rule

out the current placement. Fight when you get the response

Vicky,

when we were going through the Tribunal process recently, we were

chatting to our Ed Psych about schools and what the LEA might come up

with as there alternative to the very expensive private provision we

wanted. We discussed the local ASD provision and how they couldn't

suggest that because it was full with a long waiting list. I can

remember being stunned when she came back with the reply ' the LEA

can insist the school find a place for him'!!!!!!!!!!!!!! So it is

possible to get into a full school if the LEA wants your child there

to save money - they are all powerful over the schools they govern it

would seem!!!!!!!!!!!!!!!!!

I'm not sure how this will help you in your situation, as you are i

think looking at similar schools, but at least it may be useful for

you to know it is possible. If it was me i would ring IPSEA up and

discuss your situation with them.

Thanks everyone, unbelievably this was a suggestion by CONsensus mediation before last tribunal, LEA still refused preferring to go to tribunal.

They said they would not make a special case out of !

I tell you people you have seen nothing till you see this lot here, sometimes I think none of it is happening, just a very long nightmare lol.

Have you contacted the papers with your story? LEA's hate bad publicity

so it might have some effect.
