Guest guest
Why would SS ask you to go to a judge? I would hire an attorney but before you do that you should contact OPA Office Protection & Advocacy. They could help you out with attorney costs. r

Guest guest
But the thing I don't understand is that I was only turned down at the inital level not the reconsideration level. I have never filed an appeal - this is my first but they told me when I called them that I would have to do the hearing. Bobbie
Guest guest
No, I haven't filed anything. I was getting ready to file my request for reconsideration because I'm running out of time. I have 12 days left to do it because I was waiting for stuff from dr's and lost track of time. I called them tonight to see what information that I needed to fill out. I hope this makes sense. So I should still proceed with the attorney? Do you think maybe they want to see me because I'm considered young? Bobbie
Guest guest
Bobbie, How old are you? I was 32 when I applied but I had an attorney from day one and I had two hearings and it took me almost 4 years to get. The first judge seemed prejudiced about my age and denied me right away. My lawyer wanted to give him info on CMT and he didn't even want it. The second judge was nice and seemed to be on my side because SSD had their own doctor there and she didn't like him asking the same questions that I already answered and she took the info the lawyer gave her and I got accepted after that. I don't even think a lawyer will take your case unless they can get a postponement so they can go over your medical records. I wish you luck. Guest guest
Tommy, Thank you. I'm 32 was 31 when I applied. I talked to an attorney today he told me to go ahead and file the appeal. He will review the facts when it goes to the files and decided how good of case and have and if he will take it. Bobbie
Guest guest
I printed off all the forms, have to fill them out tonight. I have all that plus notes from my doctor saying I can't work and results of my MRI to send in. I know that according to my yearly statement I have enough credits to get SSDI and when I originally applied they told me I qualified to try to get SSDI. I understand where it would be hard to give exact details not knowing all my details. I appreciate any advice and input you can give me. I got in touch with a lawyer from there he said that he would get my file when it goes somewhere, he is going to sign a release form for me to sign. He will review it and let me know why I was turned down, how strong of case I have, anything I might need and if he will take the case. Guest guest
Bobbie, I'm glad you got everything straitened out and found an attorney and I hope you don't have to wait as long as me. Good luck and don't give up. Tommy
Guest guest
I applied for disability and was approved right away. Did they send you to one of their doctors? The one they sent me to was wonderful. He saw all the things I can't do anymore. I got my first check 6 months after I applied. Good luck to you and if I can help in any way, just let me know. Guest guest
PS, I am 33 and was approved so I don't see age being a factor. Jen
Guest guest
Tommy, Thank you I appreciate it. It's seems so frustating and think they want it to be so people will give up. But I'm going to keep going. Glad you finally got yours straightened out. Bobbie
Guest guest
That's incouraging. > PS, I am 33 and was approved so I don't see age being a factor. > > Jen
Guest guest
All I was sent to was a psychiatrist but not a physical doctor. Which I think I should have been so they could see all I was unable to do. I'm glad you had so good luck. Thank you. Bobbie
Guest guest
Hi Bobbie, I am also 33 and was just approved (through disability insurance). I showed lots of evidence of recent degeneration. Best of luck, Lenka
Guest guest
Hi Jen, I was denied the first time and didn't have an attorney, and reapplied again and for the first time it seems they seem to be more on top of things. I recieved a phone call a couple of weeks ago asking if I've gone to a psychologist or psychiatrist and I hadn't, but have gone to a rehab doctor. Anyway, they sent me one more form to fill out about how my day goes and what I do daily. I would think this means they might be leaning towards O.K'ing it. What do you think? Did you have an attorney? I haven't been able to work since November and have CMT1A, herniatic disk, herniated disk disease, and scoliosis. Thanks. Guest guest
, No I didn't have a lawyer. I just presented my evidence and went to see their doctor. I described in detail what I can not do anymore. Not only do I have CMT, but I also have severe asthma, possible emphysema and I have never smoked, and Arnold Chiari Malformation and sleep apnea. Guest guest
Thank you, I turned in my appeal on Monday. And signed a release for a lawyer to review it. So please everyone keep your fingers crossed for me. Bobbie
