I have never heard of Mentor paying for implant removal anyways (Unless it involves replacement)- it is probably a ploy by your PS to get you to sign away any rights to legal ramifications. I had a mentor deflate and had it replaces in 1999 in which they had to send it back to the mfg supposedly to get the PS paid for his warranty work but if your PS is removing them without replacement he is probably self paying and wanting you to give them up to avoid having them looked at or analyzed so he can avoid any "issues". I had Mentor implants and still have them - in my closet! They do not have to be returned unless of course your dr. is telling you the truth about Mentor paying for the removal which I think is very unlikely as I just had mine removed in 2003 and Mentor wouldn't help me a bit. I tried calling and sending a letter. Any advice, girls? Could I be wrong here? I am not sure but if I were you, I would look into it as I think it would be very important for you to have them looked at by someone outside of Mentor to make sure they are ok and not a health risk. For example - mine were looked at and found to be leaking and full of mold and fungus and bacteria so I had to seek treatment for these conditions so it wouldn't spread. 12 different organisms were found in mine as well as chunks,etc. I don't know the details of your case and how long you have had them, etc., so maybe you are beyond the statute of limitations and unable to do any thing legal wise anyways but I think you should wait until you get more responses from the other girls here about this issue before you make any decisions or sign anything else. They must have had a ton of surgeries in the last year or they would not be offering - I just had my explant in April 2003 and they wouldn't even listen to me. If someone's offering you money, there's a REASON they are offering you money. Most of us never see a dime, and this is what is customary. The most the manufacturer does for us is give us a new set of implants free of charge when they rupture. I'd have your implants looked at as well. Did you by chance have the implants put in in Florida? Just please look into getting your implants into the hands of someone you trust. I had to sign a form authorizing my Plastic surgeon to send them to MENTOR after removed and replaced. I was told that mentor would NOT pay for the surgery if I had not done that... But he had to send back the salines cause they didn't seat well. He got a check for $600.00, I guess for one, because in his report he wrote that it had a pin hole. Funny, I don't remember that being the reason for the return. He had me endorse it over to him. It went towards the next anesthesia for the next implant w/ Silicone, in 2000. I know that the company must be shady and also they know that these implants are nothing but problems...... Talk with Kacey more as she is in TX, too. I am in Florida. I had a terrible time with Mentor and my original PS. He pulled the same thing on me when I had a rupture and had it replaced in 1999. He made me sign this paper and send it back - I was so freaked out about the rupture and I didn't have any money for surgery at the time, so I did whatever he wanted. In 2003 when I had them removed and realized how sick they were, I tried to obtain an atty. I had one for several months and he obtained all of my medical record for the last 10 years. He said I had a very good case... I had also asked my original PS for all of my records prior to explant as I wasn't going to go back to him and he gave them to me so I had already looked them all over. The letter he had me sign back in 99 when the replacement was done, I signed AFTER the replacement surgery on my follow up visit. I was on serious pain meds and he slipped it in front of me saying that he had forgotten to get me to sign it and without my signature, he wouldn't get his $$ back from them and I would have to pay for the operation. He claimed that it was just a note so the factory could accept it back and research it since it was registered in my name. I didn't even read it as I was on meds and scared he was gonna try to back charge me for the surgery. Turns out - a few moths ago, my atty drops the case. He said that this letter was in my medical files from my PS saying that I would not hold them or mentor responsible or EVER sue them as they replaced one implant for free. It totally screwed me out of all my rights and I had no idea what it even said. I started going through my records and the letter was no where to be found - the Lawyer sent me all the records he had obtained in case I got another atty and the stack of records from my PS was three times as thick. They had left a TON of stuff out when I had requested them. HERE IS THE WORST PART: included in these papers was a letter sent to him by Mentor after the analization of the ruptured implant saying that it was contaminated. it said that it was filled with foreign white and yellow materials consistent with mold and bacteria and would highly suggest that I receive medical attn for it. The Jerk never sent me this letter - it was dated in Aug. of 99 I think and I never moved, changed jobs, or changed my phone number. Has I known this info, I would have immediately had both removed as I was trying to get pregnant. It sounds like you have a case against this doctor, if not against Mentor! . . . He certainly had an obligation to inform you! . . . The consequences for your child are outrageous!
