Trishi,

One reason you have not found anyone elses name against HEBisd for due process

or mediation is that it was probably settled before it went before a hearing

officer. I speak from " experience. "

I am not in that district but I know this happens. This allows a district

from getting their names in print as having problems or judgments against them.

Go figure. Sounds messed up, huh?! That is the way they work. Dont be

frustrated, just know that you are probably not the first to go there. Many

have probably done it, just got it swept under the rug.

Remember, stay focused and go in there and dont take anything personal. You

are there for your child and do not settle for second best for your child.

Also, do not let them get you on a " rabbit trail " as far as a fact or issue.

That's along the lines of my thinking. Someone else emailed me privately

and the district settled with them before they had to file due process. One

part of me says whatever gets my son what he needs; however, I've tried that

track with them before and they didn't keep their part of the bargain. I

won't compromise this time. Ask my family, I'm like a dog with a bone and I

won't let it go.

interesting that it's somehow in our blood to fight tooth and nail to make the

school districts step up to the plate and do whatever is necessary for our

children but not day cares.

Thanks - that is something I think I have said at every single ARD for

either of my two kids: " Do you mean that M is the only student who would

benefit from this? Wow! " Of course their answer is " well, of course not,

but .... "

Yes, it would seem inconsistent, except that the IDEA is the federal

responsibility of public schools, not daycares. However, I have

found private schools, including day cares, much more willing to

address the needs of my child, even wihtout a legal obligation to do

so - probably because they know enrollment is optional and they are

subject to parental choice vs. our guaranteed tax contribution to

public schools regardless of the effectiveness of services, or if

they even provide any services at all to our children. Not much

incentive to work harder if they get the tax $$$ no matter what.

With daycares or private schools, if they can't or won't meet your

child's needs, you can take your money and walk. No fight needed.

There are many daycares and private schools that refuse to enroll

kids with special needs because of their behviors and staffing

needs. you must be fortunate that your child is well behaved.

FYI guys...One reason they are hesitant to enroll, is that if they knowingly

accept a child with special needs...then they are required by law after that to

provide appropriate programming... in other words.... they then are as

accountable as the public school system to the child. At least that is what I

was told at a 4day conference on IEP law in Little Rock once. It's been years,

but that is worth investigating, I think.

Since Capitol School of Austin in not an autism center - it

specializes in language delays - and makes no claims to address

behavioral issues, it doesn't seem that it would be appropriate for

a child with behavioral problems related to autism.

But at least there ARE options out there. It's really not realistic

to expect all private schools to accept all children regardless of

their needs or the schools' capabilities. In fact, refusing a child

they cannot effectively provide for (instead of just collecting

tuition money) could be viewed as doing a service to our children so

we can seek a truly appropriate placement. When our son was turned

away from a private school, we found one that could meet his needs

effectively. Biggest favor they could have done for us.

I'd really be scared if all private schools were outlawed and we

only had our designated public school as a possibility to educate

our children - typical or not. I'm sure many of us have had a public

school claim to have an appropriate program for our children when it

was clear they didn't, only to see our children flounder or regress,

yet the school insisted the child was making progess. Sometimes when

something is a legal requirement, like the IDEA, the emphasis is

more on not " getting caught " than actually following the law. This

is not true in all our public schools, but not unusual either.

Our state is infamous for funding seminars put on by law firms for

teaching the art of legal compliance to our school districts with

little to no emphasis on meeting our children's needs, with autism

sometimes being a full-out butt of the joke. A certain " Autism: The

Sky is Falling! " Chicken Little skit comes to mind. Unfortunately,

this type of mindset is being indoctrinated into our public school

special ed administrators (paid for by our tax dollars - no less!),

so it is no wonder when we face down a united front at ARD meetings

who are clearly there to smile and humor us and don't take our

children's unique needs seriously. This becomes a high stakes

political game about dollars, and our children's futures are the

currency with which they play. Those are some seriously high stakes.

And sometimes when try to exercise the parental safeguards in the

law, such as your right to an Independent Educational Evaluation,

they file suit on you as our school district did. In those cases,

private options become essential.
