Maybe I missed something here. The school is required to pay for services deemed necessary by the IEP team if the child falls under the guidelines of ESEA (Elementary and Secondary Education Act) and IDEA. I believe that it begins with kindergarten. The LEA does not have to test a child for an IEP until there have been two years of problems (age 7). I am not an attorney, this is knowledge that I gained as an advocate with WVPTI (WV version of PEPPINC). The school can ask you for Medicaid info but youdo not have to provide them with that information. Simply refuse to give it - that's okay.
