The school is required to pay for services deemed necessary by the IEP team if the child falls under the guidelines of ESEA (Elementary and Secondary Education Act) and IDEA. I believe that it begins with kindergarten. The LEA does not have to test a child for an IEP until there have been two years of problems (age 7). I am not an attorney, this is knowledge that I gained as an advocate with WVPTI (WV version of PEPPINC).
