Please take some time and read this in its entirety, and please pass it along. All prayers are appreciated. And any help that you may be able to give would be helpful, or if you know of someone who could help the Rabold family, please get in touch with Mrs. Debby Rabold as soon as you can. At the bottom of the email, you'll find an address for the PA Board of Pardons and also where is being held. Mrs. Rabold provided this additional information:

" is 27 now. He will be 28 on April 23. He is no threat to the community, as being severely malnourished and weak, and having sensory integration disorders, he just lies on his bed all day and tries to shut the world out. Doctors, and therapists who treat sensory disorders, are waiting to give the care he needs to be well. I am a home health nurse who cares for people with neurological disorders. My daughter, and my daughter-in-law also both work with neurologically-injured people, and they are able to help me care for ".

Here is the detailed info Mrs. Rabold sent me:

was born on April 23, 1981 at St. ph's Hospital in Carbondale, PA --- which is just miles from where he is presently imprisoned at SCI Waymart. Senator Mellow is the senator there. [st. ph's Hospital no longer exists, as it merged and is now called n Hospital]. was diagnosed with Autism Spectrum Disorder by Dr. Harold E. Buttram, MD, FAAEM.

On March 13, 2003 was arrested and charged with attempted homicide. The prosecution had no physical evidence to have placed at the scene of the incident to convict him with, but that did not stop them from filing charges against him. was held at Monroe County Correctional Facility for over a year. On March 24, 2004, he was transported to Norristown State Hospital for evaluation of competency to stand trial. They maintained that he was not competent. During my visits with I observed that he [and all the other patients there] was very over-medicated, his medical needs were not being met, and he had witnessed a patient being dragged out of bed in the middle of the night and beaten by staff.

I reported my observations to the Department of Public Welfare, and NSH came under investigation. The NSH doctors called me in for a meeting on August 4, 2004. That meeting apparently convinced them that I did know what I was talking about, would not back down, and they were in hot water. On August 16, 2004 magically became competent to stand trial and was transported back to Monroe County Correctional Facility -- where he was held until his trial date, March 29, 2005 [over 2 years after arrest]. had never waived his Rule 600 Rights ["right to speedy trial"].

The opening of the trial transcript reveals that collusion between the prosecution and 's public defender took place during voir dire -- in that the jury was never challenged with finding guilty of having committed a crime -- rather their only challenge was to decide if was mentally ill or legally insane. Autism is not synonymous with mental illness or insanity, and certainly not with criminal behavior -- it is a biological and neurological disorder that is treatable.

Notwithstanding, on March 31, 2005 the jury, having been denied knowledge of the exculpatory evidence, found guilty of attempted homicide and a string of other charges that had been added on for decoration. On August 11, 2005 Judge Margherita "Patti" Worthington sentenced to 14 to 28 years in prison. ended up at SCI Albion, and being unable to make his visitor list independently, he was allowed no visitors for over 2 years.

On December 27, 2006 I filed the first of 4 actions pro se in federal court citing violation of federal RICO statutes by Monroe County to bring about a wrongful conviction. [03: 06-CV-2474 ARC - Scranton]. Judge A. Caputo dismissed my complaint.

On October 30, 2007 the Pennsylvania Supreme Court granted allocatur. I filed a habeas corpus pro se in federal court [03: 07-CV-2031 RPC - Scranton] on Novermber 6, 2007. On November 9 was transported to SCI Waymart with a 3-week layover at SCI Rockview [where was tortured with electricity and forcibly drugged]. arrived at SCI Waymart on November 30, 2007. On December 10, 2007 I finally got to visit , after being denied all access to him for over 2 years. was emaciated, and I observed the wounds of electrical burns on his body.

Judge P. Conaboy refused to entertain a pro se habeas corpus action, and ordered me to obtain legal counsel for within 10 days. I immediately requested that the judge appoint a federal public defender to represent . Judge Conaboy refused to appoint counsel, and dismissed the habeas corpus -- however, he had his letter mailed to at SCI Albion instead of to me -- so I would never receive his letter, nor would , as he had already been transferred to SCI Rockview.

Having received no response, I re-filed the habeas corpus in burg with a new number [03: 08-CV-0445], hoping to get a different judge. The habeas corpus went back to Conaboy. I filed many addendums onto the habeas corpus, including one about being tortured at SCI Rockview. By March, having received no response to the habeas corpus, I went to burg and went to Chief Judge Yvette Kane's office. There her staff went on the computer and found the "returned undeliverable" letter.

I filed a request for recusal of Judge Conaboy. Judge Conaboy refused to recuse himself from 's case.

Everything that I had filed in federal court I carried across the street to the Capitol Building and gave to the PA Supreme Court. I tried to dismiss 's court-appointed conflict counsel [who was working with the prosecution against ], and file an appellate brief pro se. I was informed that the Rules of Appellate Court forbid the dismissal of counsel and the filing of any documents by anyone other than counsel. However, since the documents I submitted had the federal court stamps on them, the clerk did take all that I gave her. However the documents apparently never got to the Supreme Court judges. Being "represented" by court-appointed conflict counsel, was denied appeal by the PA Supreme Court.

remains at SCI Waymart, where he continues to be medicated with powerful mind-altering drugs that carry life-threatening side effects. On August 11, 2008 Dr. Harold E. Buttram, MD, FAAEM visited with me. He was very upset with the "care" that is receiving, especially the over-medication with drugs that can cause irreversible neurological side effects.

On December 15, 2008, having exhausted all legal remedies, I delivered an application for clemency to the PA Board of Pardons. I received some phone calls from the Board of Pardons, and was advised to have the application request changed from "grant me a pardon" to "commute my minimum sentence", and I was advised to submit a letter requesting expedition of 's application due to his extremely serious health condition, and the inability to obtain appropriate medical care from the Department of Corrections. I did follow that advice.

On February 5, 2009 I attended the Board of Pardons hearings. 's name was included as "new business - motion needed to expedite consideration of application". The five board members sat in silence, and nobody made a motion to expedite 's application. ..... that is the point we are at right now ....... On Sunday February 8, I visited . He said that he had already been told on Friday by a corrections officer [Mike ] that the BOP had denied him expedition. I found it interesting that the prison staff had knowledge of an event before any paperwork had been sent out.

Thank you for whatever help you might be to my son. He needs to come home and receive appropriate medical care before he dies of starvation or over-medication.
