I got a real runaround and finally someone from the duluth area called to tell me that I could not do kombucha because of the alcohol content in it. I did start by asking the health inspector (who didn't care if milk was there if labeled for pets--she did not have to do anything with pet food). I had enough to do anyway without selling that stuff so didn't bother with it past that point. It is sold at a few markets. My advice--I have NEVER seen the Dept of Ag at a farmers market checking on things. I have seen the local health depts doing it tho. Just make sure you label it and if they say no, act like you don't know anything! lol It is better to beg forgiveness than ask permission. And markets change from county to county and city to city in some cases. Example--EVERY market other than MPLS would let me bring in eggs and have them in a cooler. MPLS health dept wanted refrigeration and commercial units. Didn't matter.
