RE: State-issued medical practice directives (HF 1681)

PLEASE ACT NOW! CCHC's efforts and yours are having a real impact.

The MN House now plans to pass House File 1681 quickly before any

more opposition can be built. Although one legislator informed us

that the House was not going to bring up the bill until next week,

we've just found out today from two news reporters that there may be

an attempt to bring it to a vote on THURSDAY - April 1st! They want

it passed before the public figures it out.

There are THREE things that we need you to do TODAY:

1) As someone who has already signed our citizen petition, we need

you to spend 5 minutes thinking of FIVE PEOPLE (family, physicians,

friends, colleagues) you can ask to sign the petition. Then you can

email the petition and the online petition link to these 5 people.

Ask them to review the petition, sign it, send it in, and then just

like you did, have them think of 5 people that they can ask to sign

the petition. And so on and so on... WE NEED MORE PETITIONS FAST!

2) Send an email to ALL legislators and the Governor (addresses

below). For maximum impact, make sure that the email has CCHC in the

Cc line (carbon copy). Ask your FIVE PEOPLE to do the same. Find

below a SAMPLE LETTER.

3) If a co-author of the Bradley bill is your legislator (see list

below), ask him/her to not only vote against the bill, but to get OFF

the bill.

CITIZEN Petition to 2004 MN Legislature

OPPOSING GOVERNMENT-ISSUED MEDICAL PRACTICE GUIDELINES, AND

STATE GOVERNMENT MONITORING AND TRACKING

OF PHYSICIAN USE OF GUIDELINES

I, the undersigned citizen, oppose " best practice guideline "

initiatives found in bills such as House Files 1681 and 2038, and

Senate Files 1760, 1915, and 1112, because they will empower

Minnesota state government to:

* MAKE MEDICAL TREATMENT DECISIONS: The Government must not be

authorized to decide what medical practices physicians and other

practitioners should follow. This will politicize medicine, limit

individualized patient care, undermine medical decision-making, and

ultimately lead to government-run health care.

* COERCE AND INTIMIDATE DOCTORS: The Government must not be allowed

to " track and monitor " practitioners or require physician adherence

to government-issued practice directives. Such exercise of state

power to modify physician practice behavior will limit individualized

patient care and is inconsistent with a free society.

* VIOLATE PRIVACY RIGHTS: Health officials must not be authorized by

Government to invade the privacy of patient medical records to track

patient care or to monitor physician compliance with

government-issued practice directives. Patients have a right to keep

their private medical records free from government inspection.

Patient confidentiality is essential to building and maintaining

patient trust, and critical for facilitating frank discussions

between patients and their doctors.

* CREATE CONFLICTS OF INTEREST: Government agencies must not be

allowed to offer " financial and other incentives " to encourage

physician cooperation with government-issued practice directives.

This threatens the patient-doctor relationship, violates the private

contract between patient and doctor, creates conflicts of interest,

and encourages breech of medical ethics.

* RESTRICT INNOVATIVE TREATMENT: The legislature must not grant

doctors who follow state-approved practice guidelines an " absolute

defense " against medical malpractice allegations. Such a law will

discourage doctors from thinking and acting " outside the box " in

medical decision-making, ultimately leading to less individualized

and less innovative patient care.

Please deliver this signed Citizen petition to Governor Pawlenty and

legislative leadership.

Dear Rep._________ and Governor Pawlenty,

I am opposed to House File 1681 - the omnibus health and human

services bill authored by Rep. Fran Bradley. The bill authorizes the

State of Minnesota to begin to control the practice of medicine.

The legislature must not pass legislation that interferes with

private treatment decisions, puts medical decision-making power in

the hands of state officials, violates the patient-doctor

relationship, intrudes in private patient medical records, and

restricts the freedom of patients.

I urge you to vote against House File 1681. If your answer is yes,

please send me a simple response to affirm that decision. If you plan

to vote for the Bradley bill, I request an immediate response with

the rationale on which you base that decision. I await your response.
