And I'd be after that school/district faster than you can say Jimney Cricket! I would call the district superintendent and report the incident as well as the fact that you've been blown off by the principal. In addition, I'd have Liv write out the story of the incident the best she knows/remembers. Sometimes incident facts can get confused over time. Have her sign and date it so you have documentation. And I'd think it would be best to hand write it so that its obvious that changes haven't been made to the document. Thats all I can think of! Good luck! Sadly things like this happen with young people...they should know better but don't always use their heads before they act... My husband is a junior high special education teacher & he sees a lot of things happen between students. In fact his best friend is the schools guidance counselor & his daughter (who goes to the same school) was " kneed " in the butt by another student/friend & it actually shifted/moved her tail bone. She was in alot of pain & needed medication & a pillow...not fun when you are 14. If the tripping had been inflicted by an adult or school employee there might be need for an attorney but since it was done by another student...I'm not sure that is the right path as legally I think they only one liable is maybe the other student..and to sue that family would probably have a very adverse effect on Liv. Its a shame the administration didn't follow protocol very well. You should defiantly schedule a meeting with the administration & tell them how you feel about the way they handled the incident. Notification of parents is the very first thing they should have done! I dont have the desire or $ to sue anyone, but I certainly think that this derelicts family should be responsible for all doc bills. Im already down $100. Im now wondering if I need to file an official police report to make sure that the family does have to pay medical bills related to this intentional injury? Since, the school has not yet called me back. This kid must also be suspended. Gosh, I really cant believe that we may have to file a police report...I need to talk to the police for guidance, maybe... Thanks for your support, hon. It by no means makes her a legal expert, but she's really upset no one did anything and/or even told you and Liv's arm was BROKEN. That's a big problem. Like someone else said, there's not a lot you can do about being injured at school, but there should definitely be something done about the teacher(s) who did nothing. That's unacceptable to me. Definitely go to the superintendent- its also unacceptable for the vice principal to have not called you back- they are doing everything wrong! Guest guest Posted October 29, 2011 Report Share Posted October 29, 2011 I've known kids not in casts that were SERIOUSLY injured by other children while in the presence of adults who didn't do the right thing in responding appropriately to the situation at the time....probably they were too busy talking amongst themselves instead of supervising and then tried to cover their (blank) when it came to bite them in the (blank). Sometimes stuff just happens unfortunately and it's enraging when it's your child that get injured. You are doing the right thing in getting the principal and even superindendent made aware of what happened. Getting an attorney also gets people listening pretty quick too. The administrators will have their excuses but bottom line of what you want out of all of this is to make sure that this doesn't happen again by means of better supervision as well as an apology from the girl who did this and her parents to your daughter.....the latter may be difficult to get because if they get an attorney as well that might be an admission of guilt which is what they want to avoid. Hopefully you have insurance to cover this injury and can just chalk it up to experience and won't be needing to come after the other girl's family for the bill.....this actually happened to a good friend of mine whose daughter almost lost her finger due to another child's recklessness and had to go through court proceedings in between surgeries and rehab to "prove" the other girl actually did it and they settled on the amount of the medical bills because they didn't have insurance. Unfortunately after all that, that the victim girl lost use of the finger due to nerve damage caused by the injury....sad but true. Other kids can be very mean. Anyway, I would call the principal & demand a meeting with all the parents of the students involved “face to faceâ€...U may want to take an attorney or I would atleast record everything! You are handling it better than I would b/c I would already have been up at the school! I know you are fuming....handle it now! If the principal will not respond contact the school board! That is pure bulling & there is suppose to be a ZERO tolerance for that sort of BS! It is difficult though because you probably don’t want to make Liv a future target for “mean girlsâ€....UGH.....I could not imagine if some little idiot did that to one of my Girls....and all the issues your Daughter has been through it just make me furious that none of the adults addressed it right there and then! Guest guest Posted October 30, 2011 Report Share Posted October 30, 2011 I can only imagine that allowing this kind of bullying to happen without seeking proper resolution including admission that it should never have happened and won't happen again will only lead to more bullying. And it may not always be Liv, it may be many other young students. But the message being sent to the group of girls involved with putting in so much effort to ensure that she was tripped, and contrary to the 504, the tripper very definitely meant to hurt her I am sure, knew who she was and that extra care may be warranted for her physically. I was a victim at age 5 of bullying in a school that just didn't care -- it was a thing. Some of the 5th and 6th graders beat as hard as they could as many grade one kids as they could before all the grade one kids where either unconscious on the school ground or gone. Every single day. Lip service was all the school gave. This was back in the days where you had to send your child to the district school, no getting around it, no ands ifs or buts. It took a lot of doctors reports before my parents where allowed to put me in another school and I missed a lot of school. And obviously the neighborhood my parents had unwittingly purchased their house in was a very bad one. My point is, if bullying is allowed unchallenged it can turn into a kind of bullying wildfire -- even a " tradition. " Is this really what the school wants to be known for? yes, it might be hard for everyone, including you to get on top of it and make sure that everyone understands that this is not acceptable, will not be tolerated and there can be serious consequences to everyone involved. Sorry for the rant. Anyone who feels their child should be allowed to get away with the odd act of bullying because it was simply a case of they did not think is unacceptable. In this case, yes this person did -- they thought so hard that when the missed tripping her they reached up and pulled her to the ground. I should hope that one day the girl who did this will look back and be thankful that someone took the time to point out that we can't treat others this way. Not even for our own amusement. If she is interested in that kind of behavior maybe she should have stayed at home and played violent video games of watched some violence on TV. To actually inflict pain on another is unacceptable, and she should find her outlets if that is the kind of person she is elsewhere. Hope you don't mind the rant!
