You will tell Social security this only! to receive maximum benefits: They are disabled and you are applying on their behalf. They reside in your home,but are a separate financial household beginning, the day of their 18th birthday. As of their 18th birthday they will be expected to pay a flat fee of $400.00 for room and board. They will also be expected to pay back for the months they cannot pay prior to approval of benefits. Elie will be entitled to benefits if he never worked before, found to be disabled and is eligible for benefits starting with the first month after the month in which you filed the application. I hope you filed this the day he turned 18 or a month before. Allowable assets $2000.00 for an individual. A $1500.00 burial expense fund is exempt. I hope this helps. Charlyne Mom to Zeb 10 DS/OCD ? They told us that they would be calling to determine the rent charged. Did not want to hear now. (We had already figured $400 and hoped that was correct.) BUT they said that the first check would come in Spetember and only start at that time. Seems to me it should start as of July even if it takes until September to start paying him. Could not get an answer on this at the website. Guess we wait until Spetember and see if it is just the $570 some dollars or that plus retro and interest as SS has always done before. I have a huge notebook full of information that was given at a workshop called Vision for The Future 2003 held by the Texas Dept. of Health and The ARC of SA. It provides Community Agencies and Resources for Families of Children with Special Needs. I actually learn more reading everyones input. Y'all really have been the best resource for me, even if it varies from state to state still it gives me comfort that it would be similar in some ways to work around our State rules and laws. Then it would make some sense to review the areas needed. My BIL and sister has a soon to be 21 y/o son with special needs and I can not always rely on their information when I'm curious about stuff like this. Sometimes its like pulling teeth for information. They are great parents to him but sometimes they make things sound like they're too reserved. I never really confront them with stuff like this unless I come across a certain bridge with and then they'll want to share information. They did tell me that they did not have funds for Guardianship but that they were looking into it and that was the last I've heard. Nothing about how to go about it for now and I do not know if they even had a POA. Like I'm curious what are they're plans when he is out of high school? I'm always blah blah about and she'll listen but they are just reserved with their information. Who knows maybe they do not actually have an answer. I do know they would like for him to continue living at home. My BIL is building an extra back room behind their house for him. When my mom calls she'll ask me what information are you learning today? I guess I'm like Curious , how did she know? I told her about my concerns about 's future or whatever pertaining to the subject of the week and then of course she'll ask me what are my sisters plan after she hears my story. You see, she's the mama and she is also left in the dark. What I do know about when they had applied for SSI they did receive back pay from the time they had applied. The SSI office had also requested for them to include a letter stating that he was a separate household and would be paying rent, utilities & food. He is receiving the full amount. Would I dare ask how they are spending it? I'll wait until she is ready to share that info in the mean time. Like what is his portion? Nah, I won't go there, yet. I am so proud of my nephew, today a small town which is out skirts of SA.. A Fire Dept has invited him out to spend some time with them as they are sponsoring a Festival and they just adore him as part of their staff. Maybe this would of been his call as a future fireman. He's not just hanging out with the staff its the Fire Chief & his wife who likes to hang out with him and keep him involved and he just loves it. Love it that these people include him in as part of their team. Thanks. The attorney fees were $600.00 and that included the filing fees. It usually isn't a huge amount of money. Applying for SSI is the same no matter what state you live in. I think I will pass on the SSI applying for Zeb. I really don't need to fill out all that paperwork and have to tell people my business. They can keep their money. I have heard of other people getting into problems with having to pay the money back. I will opt to wait until Zeb is 18. I hope you can get your nephew a computer, good luck. So far the lowest fee starts $2,000. & up that many of us have confronted. Annual fee are about $150 and up. I'll still keep my eyes open as I was given some legal resource information. Today, I recieved an invitation for a workshop to address this Guardianship and Consveratorship/Guardian Ad Litem, Government Benefit Eligibility, Financial Security and Funding Options. I guess I'll be invited alot to these type of workshops when Planning for the Future. To this day we are still having to pay SSI as my dh's income had increased, another issue which we had encountered back in 1996. Then I was told we could of appealed it as it was not our fault as we kept them updated with the check stubs. Eh, my dh did not want to bother so we were allowed to pay a very small amt. monthly. The office said when he turns 18, they would deduct the amount. True, on the expenses on my nephew. Plus they are adding another room for him. My nephew will also undergo surgery to his jaw line as he has a very small one which is part of his syndrome. I've requested for a free computer for him which a business will be providing for him. I would hate for him to regress with any speech he has as he will be unable to move his mouth when this happen. This was one of my sisters concerns and she thought he would benefit from a computer. I was hoping they would save some of his funds for a computer but I ran across this site and had some luck recently that they would provide one for him. He does sign & could use visual cues. He does not write only his name and coping from an article. Thanks so much for the information you've been sharing. I know it won't be long when we cross this bridge. I know in Wisconsin the person who the guardianship is for is responsible for the fees out of their funds- not the guardian's funds. So, if the individual doesn't have funds then they are considered " destitute " or something. and don't have to pay the whole thing. Something they keep prett secret around here.
