NY Killer Sentenced

Albany, N.Y. -- and Carey got what they wanted, the

maximum sentence for Edwin Tirado, the man convicted of killing their

13-year-old autistic son, .

" I was very much a wreck about this day and I'm glad it's

over, " said

Carey, Carey's mother.

The former O-D Heck worker was convicted of manslaughter back in

October. A jury found that Tirado used an improper restraint on Carey.

The man convicted of killing 13-year-old Carey learned

his

fate Friday in Albany County Court. Billups reports.

Both parents read victim impact statements at Tirado s sentencing.

Carey, unable to keep his composure, said his heart is broken and

the pain he and his family feels is immeasurable. The Careys asked for

the

maximum penalty in their statements. Tirado had nothing to say.

" I think he should apologize, " said Carey,

Carey's father.

" He has never expressed any remorse in this entire situation, "

said

Carey, Carey's mother.

But Tirado's lawyer, Donahue, says he has expressed remorse.

He's just extremely shy.

Donahue said, " When you talk to people who know him, it's never

been

easy for him to talk. "

Tirado will serve five to fifteen years in state prison. Assistant

District Attorney Rossi says Tirado's deserving of the sentence

because of his negligence. He says Tirado should have immediately sought

help when he knew was hurt.

Donahue maintains Tirado's innocence and he says he will file an

appeal Monday.

" The medical examiners testimony and opinion as to the cause of

death

was based on hearsay, I think there's a very good chance an appellate

court

is going to find that improper, " Donahue said.

While this chapter may be closed, for now the Carey's say they're

moving on to wage a much larger battle.

Carey's father, Carey, said, " Our mission now is

to

help other children. As far as that being closed, we're just getting out

of

the chute. "
