The good news is that most judges are protective of kids. If you decide to go, make sure the judge sees your son for the amazing kid he is. BTW, I know this person doesn't deserve the money, but it may be way less costly for you (emotionally, etc) to just pay them. If you choose to pay them, make sure you write a letter making it clear that your son did not do this but you are paying them because.... (fill the blank). Make sure your son reads the letter. Another option would be to file a counter-suit claiming that they are discriminating against your son. You have some good evidence. That should probably scare them a bit. I was told by the police that the tapes were worthless and were panning cameras and were not aimed where my son and they were and they were grainy too boot. They are useless. Finaly have pictures of the scratch, it is so deep there is no doubt in mind the car was keyed and based on who drives it the most doesn't surprise me at all. He has never been able to he may try but after about 5 seconds he caves, he has not changed his story since Nov 4 and it is now January - even his private social worker who works with him every week tried to see if he was lying she agrees he is not. I have finally seen the scratch from pictures the cop took, they are way too deep to be just a brush with a cart - looks to me like little high school girl got herself keyed. Guest guest Posted January 9, 2011 Report Share Posted January 9, 2011 Did the police measure the height of the scratch from the ground? Carts don’t usually do that much damage. Other people’s car doors, maybe. Will the cart even match up anywhere with the scratch? If you can show that the cart couldn’t have done the damage that’s evidence you can present to the judge if it goes to court. You should make your own police report if any of the parties threatened you or any in your family. Do you have any liability insurance? Sometimes it is included with homeowners insurance. If so, contact your insurance agent. They might have an adjuster who could look at the car. A person who does insurance adjusting on cars can probably look at the scratch and say whether it is consistent with a shopping cart. They see all sorts of stuff. Someone kicked the fender of my car (I didn’t see it) and did an amazing amount of damage. There was a large dent. The first thing the insurance adjuster said was that someone had kicked it. He could tell just by looking. I am a retired police officer. The city judges wouldn’t let anyone under 16 testify. That was in criminal cases. It is probably different in civil cases, and different judges have different policies. If it looks like you are going to court you can make arrangements to take your son to see the court room and get familiar with things ahead of time. This is beneficial for all kids before court. I did call my insurance company but they can do nothing because my son was not charged with anything he was just name as a suspect - much to my neighbors dismay despite what she says in her letters. They have already had the bumper replaced so the evidence is gone. It is just the word of my 12.5 year old and their 17 and 14 year old. I did not see it so I am not even a witness and neither is the mom of the other children. The first words out of her mouth after she said she was going to look at the Walmart tapes was I am going to sue your ass. They are just horrible horrible people their son has been tormenting my son since they moved in here 6 years ago. My son won't even go outside unless an adult is present cause of this kid. They just want money - my lawyer is adamant that we do not pay them - she is not a Civil attorney but she has been helping me with the wordings of my letters back to them stating again and again and again that we are not going to pay for any damages until they can prove that my son did it. They will never be able to prove it - the evidence is not there. It is just a nightmare - I hope they go away after this last letter that was sent.
