For the first time, my employer insurance company is coming to the office for mandatory blood draws and a "couple questions". Everyone is required to give blood. They have not told us why. Is this legal? Do I have anything to worry about? I can not be refused insurance in Wisconsin due to a pre-existing condition. So, why would they be doing this? Must I tell them I am POZ if they ask??? I would appreciate any help that someone can offer me. Thank you! MikeSee what's free at AOL.com. I was shocked by your message, so I thought I'd send a quick email to my former case manager back in Michigan to ask her opinion/advice. Below is her response. Hope it helps!!---- As far as the question, all my warning bells are going off! I am certainly not an expert on the law, and obviously, laws vary state to state. What I will say it this... 1. Never lie on medical questionnaires related to insurance, as it is considered fraud, and carries penalties if discovered. 2. Mandatory blood draws with no explanation doesn't sound legal to me (but again, not a lawyer) ....it may be drug testing and they don't want people to have time to flush their systems, however, I still think it's required to tell people why they are submitting. 3. As far as revealing HIV status, as far as I know, there is no law saying it must be revealed to employers, but I'm speaking from a MI space, and who knows what crazy laws exist elsewhere. Those are my initial thoughts...my STRONG recommendation would be to seek actual legal council from an HIV savvy attorney. Also general labor law should be explored if ALL employees are being forced to submit to testing. There are also some online resources that may shed some light....
