Guest guest Posted May 30, 2007 Report Share Posted May 30, 2007 Ok- Here is what I understand after following the updates etc. There are three issues to be resolved in the general causation hearings. 1 is if combined the MMR and thimerosal containing vaccines can cause Autism, 2- if thimerosal can cause autism, or 3 if MMR can cause Autism. Right now they are going to hear 3 test cases for thimerosal adn MMR causing Autism together. Then they will hear 3 test cases that MMR can cause Autism, and then 3 that thimerosal can cause Autism. There will be a total of 9 test cases, but the expert witnesses will report in the very first test case of Cedillo vs. HHS and then applied to the other 2 test cases. It is also my understanding that the expert testimony will also be applied to the remaining 6 test cases. Each case will also be presented to the courts but will be able to call on the previous expert witness testimony without having them re- testify. I am still waiting to see if we should be working hard to get these test cases to avoid this being a big pile of 5 years worth of nothing. If I had a case in which my child got the MMR nad thimerosal containing vaccines I would be contacting the Petitioners steering committee to have them look at my case. The problem with finding the cases is that our lawyers may have some information, but for the most part no one else beside our families really knows what happened. Again I will let you know as I get more information. I gotta say that I am getting a good feeling about this and am pretty positive so far. Anyway I am not sure about what filing for Thimerosal and then finding out the MMR caused problems as well would affect your case. If you think this the case follow up with the lawyer and ask. It may seem intimidating but if I were able to supply a test case, you bet I would. The vaccine hearings, we have preponderence of the evidence- we do not need a sealed tight perfact case, we just need a pretty solid theory supported by science which we have adn then the HHS has to prove that the damage was not done by MMR or thimerosal but specifically explain that it was caused by something else. They don't have all of the documentation yet, because I believe we filed a short form of the petition in order to get in under the deadline. My point being, his case was filed against a thimerosal containing flu vaccine and an MMR vaccine that he received when he turned a year old. His attorney is Krakow of this group. Mr. Krakow - Would my son's ( A.L. Shockley) case be of any assistance? On pages 5-8, Part E, " Crisis Point in Autism Omnibus Proceedings " , They decided that they would require three " test cases " to test one of the three general causation theories. The theory that they chose for the " test cases " was the MMR combined with TCVs. Right now they are going to hear 3 test cases for thimerosal adn MMR causing Autism together. Then they will hear 3 test cases that MMR can cause Autism, and then 3 that thimerosal can cause Autism. There will be a total of 9 test cases, but the expert witnesses will report in the very first test case of Cedillo vs. HHS and then applied to the other 2 test cases. It is also my understanding that the expert testimony will also be applied to the remaining 6 test cases. Each case will also be presented to the courts but will be able to call on the previous expert witness testimony without having them re- testify. I am still waiting to see if we should be working hard to get these test cases to avoid this being a big pile of 5 years worth of nothing. If I had a case in which my child got the MMR nad thimerosal containing vaccines I would be contacting the Petitioners steering committee to have them look at my case. The problem with finding the cases is that our lawyers may have some information, but for the most part no one else beside our families really knows what happened. Again I will let you know as I get more information. I gotta say that I am getting a good feeling about this and am pretty positive so far. I missed the time frame in which to file a claim for my boys, but I want more than anything to see justice brought to those families that are directly involved.
