Guest guest Posted September 15, 2000 Report Share Posted September 15, 2000 In most states, cutting a child's fingernails (hair too) without consent of the guardian is called assault. we were always very careful in the hospital nursery to get consent IN WRITING before we did this. Also on the regular peds unit!! And taping a child's hands is also assault - probably a felony. Feel like going to oourt??? For one whole school year my son was transported in a stationwagon the school district bought just to transport Elie and one other kid who needed a low stim environment. I went to our county MHMR agency and got an advocate for now. I don't have the " class " that's required when dealing with emotional issues. They are not following Federal Law. Talk to your school superintendant and bus company person(not the driver-the transport. supervisor) I wuld have pulled my child off the bus too. & Garry, parents of (10 ds), (8 ds/g-tube), JJ (6 ds/autism/celiac), (5 ds), and Esther (3 ds). Please tell me your bringing her up on charges. I would have ran in and got a camera before he was untied. The only butt that needs smacking is hers. A charge against the bus driver and aide can be made at the local police department. THEY will need a lawyer. This is a criminal issue, not a civil issue. I would certainly make the complaint to protect both your son and all the other kids these people are around. This is not a sotly thing to do. Some states do charge a small amount (like $5-10 to file a complaint to keep people fom making foolish complaints. Sara Some of you may remember my telling you about the teacher who used unlawful restraints on my son. I needed no lawyer to file a complaint at the police station. She needed one and then she needed a doctor to hospitalize her.
