I have wondered if anyone ever took the entire issue to court, itseems to me it would be possible to get a ruling that the vaccinecourt thing is a violation of rights.debiI really don't know that much about the special vaccine court. I thought that nobody could sue in a regular court without first going thru vaccine court, and that that sometimes took years. But now I've recently read that if you have to wait more than 240 days you can opt out and just go to a regular court. I really don't know that much about what would be involved with going thru a regular court proceedure, (altho I would imagine a lot of money would be required at the very least). My children are undiagnosed and I've never really had much reason to look into this, you see. I understand there are statutes of limitation and I don't know how anyone

could file a lawsuit if it takes three years for the average child to even be diagnosed with autism, and there is a statute of limitations that is less time than that. But it does seem to me that the whole notion of making certain people go thru certain special proceedures that any other citizen who's been harmed would have to go thru, that does seem to me to in essence violate rights. But I am no lawyer..

Debi I do know something about this. If nothing has been changed recently-- the statute of limitations is three yeaars-that is three years from the time you determined there was something wrong with your child-which i guess would mean when you took the child to the doctor and got a diagnosis. That three years applies to the filing in the vaccine court. As far as that 240 days in vaccine court---even tho it has passed for most of the people who filed there-it's really still on hold thru some other process and I assume the reason nobody has gone to civil court and sued after the 240 days passed is because they don't bleive at this point they could win ina civil court. Hope this helps. I haven't followed this thread so forgive me for jumping in if I am off base

here.

BUT,

I think what I want... I want the guilty parties to 'fess up --to admit that

our kids are " toxic " kids and that the DAN! doctors are right, and that the

protocols are sound science so that those parents who are still eating up

the platter of B.S. they are being served by the public heath agencies will

then KNOW that there is a way to help their kids.

That is all I want.

A chance of some shade of recovery for all our kids.
