EPA held accountable

It was encouraging to read in today's New York papers that former EPA

Commissioner Christie Todd Whitman has been held accountable by a federal judge

for

her offical comments immediately after the collapse of the WTC on 9/11.

Apparently, Ms. Whitman made numerous offical comments proclaiming the " air and

enviroment " surrounding the still smoldering ruins of the WTC " safe " for

those working on recovery as well as for those seeking to rehabilitate the

area.

The federal judge refused to remove Ms. Whittman from a class action suit

brought by families who were damaged when they followed Whitman's public

assurances concerning " environmental safety " . The judge said: A public

official

cannot be held liable for putting the public in harm's way unless the conduct

was so eggregious as " to shock the contemporary conscience " . Given her

responsibilities to protect the health and environment for Americans, her

reassurance after 9/11 was " without question, conscious shocking " .

I sure hope those officals of the CDC and FDA are aware of this federal

judge's ruling because the day is fast approaching when they are going to be

held

accountable for " conduct so eggregious as to shock the contemporary

conscience " . Tick, tock, tick, tock, tick, tock...
