Suit Claims Mc's Fries Worsen Autism A lawsuit filed in L.A. The lawsuit, which alleges fraud, false advertising and negligentmisrepresentation by the Mc's Corp. and Mc's Restaurants ofCalifornia, seeks restitution of $15,000 for Roman Brown's medical expenses,along with a share of profits made by the company for the allegedmisrepresentation and unspecified compensatory and punitive damages. The plaintiffs also are asking for certification of the lawsuit as aclass action on behalf of other autistic children who they allege may havebeen similarly harmed. The lawsuit was filed Friday in Los Angeles Superior Court by W. Brown, who was identified as the boy's guardian. The Browns' lawyer, Alvarez, could not be reached for comment. , a spokeswoman for Mc's, declined to discuss theallegations in the lawsuit. "We care very much about our customers, and we take these allegationsseriously," said. "However, as we haven't seen this lawsuit, it wouldbe inappropriate for us to comment further at this time." According to the lawsuit, up until Feb. 13, Mc's advertised andmade official statements that its french fries did not contain gluten orcasein. Gluten is a protein found in combination with starch in some cereals-- usually wheat, rye and barley -- while casein is a protein in dairyproducts, according to the lawsuit. Neither is naturally found in potatoes,according to the court papers. "In most cases, elimination of gluten and casein from an autisticchild's (diet) results in dramatic improvements in the child's condition,often enabling the child to attend mainstream educational programs in amatter of months," the lawsuit states. But after eating french fries at a Mc's restaurant at 27776McBean Parkway in Valencia, the boy's autism symptoms of aggression andtantrums increased, while his ability to communicate and take care ofhimself diminished, according to the lawsuit. The boy and his guardian did not find out about the gluten and caseincontents in Mc's french fries until Feb. 13, when the company admittedusing both for flavoring, the lawsuit alleges. Mc's also added"contains wheat and milk ingredients" to the french fries listing on its Website, according to the complaint.
