Thanks Zoë, I'll do that. The really annoying thing is that my FIL does industrial tribunals for a living, is VERY clued up on the disability discrimination act, but all I get is a distant 'hmm' when I mention this. Could you send me the number of the independent OT please? I want to pursue getting it via the PCT first, but if all else fails, then we'll get an independent report done and go from there. He has got a statement, but it doesn't include OT or anything remotely similar. I suppose I could ask for a review to include sensory problems in his statement, that might be a way round it, then if I happened to have a report by an independent OT to include in the review... I think Vicky mentioned a few weeks back about getting my paed to add in his sensory problems into his diagnosis and go about it that way. I'll keep on going and will get there eventually, just don't see why I should have to pay for everything.

Ask the PCT to provide OT again - in writing this time and you willhave a new case that the DRC can help you with. When they refuse,write again and ask them to give you a written response outliningtheir reasons. Do a FOI Act request to get the reasons in writing ifnecessary.I was told that the Ombudsman will not be able to help unless you havebeen through all the (in your case) PCT procedures (including formalwritten complaint) first.Does have a statement - if so can you get OT put into that ata review? If its already in, dont they have a legal obligation toprovide it?I have the name of an independent OT who could do you an assessment ifthat would help....more money again.....Zoe x>> I'm still struggling along, trying to get OT for . I'vespoken to the disability rights commission, who state that the PCT hasto justify why autistic children are refused OT, but if they arerelying on some form of legislation to uphold the exclusion criteria,then the drc cannot over-ride this. I also need a specific date that Iwas refused the service, as without that, they cannot proceed. I haveno idea when I rang to ask about OT, but it was more than 6 monthsago, in which case the drc cannot help me as too much time has lapsed.I need to speak to a specific person at the PCT, who has a PA toscreen her calls and she will not let me speak to her. I received aphone call yesterday to say that the manager of OT will ring me onMonday. I told them not to bother, as I spoke to her 2 months ago andshe is quite pleased that I am fighting it as she wants the exclusioncriteria to be lifted too. I therefore think that they are not takingme seriously. My next step is to contact the parliamentary and healthservice ombudsman. Wish me luck!> > Diane>
